House rental problem please help

Hi All

I am desperate for advice if someone could help me please, my predicament is as follows:

My wife and were recently approached by our elderly grandma (94 yrs) asking if it were possible if she could move in with us as she cannot look after herself anymore (we had mentioned some time ago that if she needed to go into a "old peoples home" we would not let that happen), so we organised viewings and found a great place through Your move estate agents, we confirmed verbally at the time (about 3 weeks ago) that we would like to go ahead and the landlady and the estate agent said that as long as the references were ok all would be good to move this weekend (26th March), now yesterday we were informed that the landlady has sent the paperwork over to her solicitor to go over and they have no idea when the solicitor will go over the documents and approve, (I think after talking with the management at yourmove that is is something to do with a co-owner as the property was left to them both in a will. Here comes the best bit though -- We have ended our tenancy at our current property this weekend! Which effectively leaves us homeless!! This also leaves our grandma homeless as she has ended her tenancy also! We have also got our 4 year old son in all of his mess!!
I have no idea what to do and was hoping someone could give me any guidance as to where we stand legally or what I can or cannot demand from the agent?

Please help if you can, I am in limbo and any help would gratefully received

    You shouldn't have terminated your current tenancy until you had a signed agreement for the new one. I guess you know this now so not helpful I know.

    Has your current landlord re-let? Could you explain the situation and ask if you could stay on a little longer?

    Do you have funds to put your stuff in storage and stay in a hotel?

    That's the only two things I can think of at the moment. Hopefully others will have some suggestions for you.

    Hi, Thanks for reply, Yes the current agent has re-let, new lot move in Thursday next, I suppose worst case scenario would be to ask if we could hold fire on moving. But what if they refuse?

    We have no extra money for staying anywhere else or storage. Our major concern is grandma. We had no idea or have any inkling that this could happen, seriously.

    Can your grandma extend her tenancy at all? If so, could you move in with her temporarily?

    Hi, Thanks for reply, she was with loal council and they have re-let already I think, it was a one bed property anyways.

    In reality, most people have to sign off on one property and hope for the best if they cannot afford to have the overlap.

    Its not totally over yet, but was told today that the solicitor could take another 2 days upto a month to make a decision, been sniffing around and also think that its something to do with probate on the property, where it has been left to two people in the will?

    And just who can fund two properties for a two month overlap ?

    In reality, most people have to sign off on one property and hope for the best if they cannot afford to have the overlap.

    Have you physically left your current property yet? If you are still resident there, then even if the tenancy has lapsed, you can't be evicted without a court order, which would take a couple of months. Could your grandmother move in with you for now, and you could have a word with your landlord about extending the tenancy for another few months?

  • God only knows what this solicitor stuff is all about. "The solicitor could take another 2 days up to a month to make a decision": it won't be the solicitor reaching a decision it'll be the executors IF probate ha been settled. I'd say that this property will almost certainly be a no-go.

    Please explain to your landlord that you will not be moving out as previously planned and that they should convey this information to the prospective tenants asap. As already explained, you cannot be evicted from your current property without a court order and your landlord will have to serve you with a Section 21 Notice first giving you two month's notice that they intend to go to court for a possession order. Meanwhile you've got two months at the very least to either wait for this new property or find an alternative. Sounds like granny is going to have to move in with you while you sort this out
