Watch gaurantee

Had a watch bought for a christmas present 2009, was working fine but now can not turn the crown on it to change the time and date.

Took it back to the shop and they said they would send it back to the manufacture because it is still under the 2 year gaurantee.

They have called today from the shop to say that the crown is damaged and the gaurantee only covers the mechanics inside the watch.
When the shop was questioned about how it could have been damaged they just said its what the manufacture had put on the paper work - crown damaged.
Asked them how it could have been damaged and assured them that it had not been damaged by myself because it as been looked after well. They said they had done all they could by sending it off. The shop dont seem bothered now they have got there sale.

I have told them to phone me back when they have got a better explanation from the manufacturer of how the watch as been damaged.

What are my rights, where do i stand with this.

    The manufacturer is saying you have damged the watch so is not repairable under the warranty. Take the shop to court if you think you can win.

    If it was me I would try and talk to the manufacturer and see what they are really saying.

    I agree with Hintza - talk direct to the manufacturer if possible.

    One thing to think about though - maybe you DID damage the crown without noticing and that's why you were unable to change the time & date.

    thanks to both,

    I will see what the shop come back with and get the contact details of where they sent it, i dont think i could have damaged it because i have taken good care of the watch and i have never dropped it or knocked it.

    Also thinking about it when i took it to the shop the manager of the shop started fiddling with it and got the crown to move but it was still really stiff so she said she would send it off she may have damaged it trying to fiddle with it.

    If it is a particularly valuable watch, try getting an independent assessment?

    update -

    Spoken to manufacture tag - they say that the watch as been damaged by a tool which has marked and dented the crown.

    They recommend this could have only been done in store because of the tool used. And they are happy to put this on paper.

    Spoken to shops head office - they are looking into it again will be back within 3 days.

    The shop had said i could have it serviced and repaired for £210.00, and tag have said it only costs £160.00.

    Will update with outcome.
