Salary payment has been paid into my old bank account by mistake

Arrrrrrrrgh help!

My last salary payment has been paid into my old bank account by mistake (as the originators were given my new bank details). This overdrawn account makes up a part of my IVA.

The payment was made on the 18th my creditors meeting was Monday, is the the bank allowed to keep this amount, if not how do I get the money back

    Speak to the accounts department who paid it, they may be able to reverse the payment, but this needs to be done quickly.

    If you were over your overdraft limit at the time, then the bank have no legal obliation to give the money back to you. If you are within your OD limits, then draw the money back out, assuming your bank account is still open and they havent closed it already. If at them creditors meeting you owed them say £5000, now you only owe them £3000 of example, it will be down to the bank wether or not they give you back the money, I'm afraid they wont care if you cant buy food or pay any bill for the month, so if they have swallowed it up, speak to your IP as they may have some clout.

    Purely speaking "off the top of my head", I would assume this is a problem for the department who paid it, as it is they who sent it to the wrong account, being in possession of the new account details. They should seek to get it back and pay into the correct account. However, this is not an ideal world :-(

  • Im on a roll - 1st my IVA got agreed and now I have my wages back, maybe I should try the lottery on Friday :-)

    I explained the situation to the Halifax who then informed me that I needed a letter from my IP explaining the situation and that they had no claim on the payment as a whole and they would release it = and they did :-)

    Dont forget that would have to be split between your creditors and any on here that have given advice!!:D

    I think if you won £117,000,000 then i am sure you can pay all your debts off and still have a little bit of change !
