Making a Chargeback for EBAY Item

I have purchased an item that was brand new on Ebay and did not work. £64.99 It was a wireless network card for a computer. I contacted the seller for a refund but they simply told me to contact the manufacturer as it had a warranty. The manufacturer told me to go back to the retailer. (the Buyer)? who didnt want to give me a refund.
I disputed the transaction with PayPal under item not as described. After a month PayPal have told me to have it independently assessed as faulty by an impartial third party. Such as PC World! and fax them a report. I enquired at a shop who said it would cost £30.PayPal said I would not be reimbursed the cost either so my claim is now £64.99 - 30??ish = £34.99!!!! I think this is disgusting and wrote to them saying I am not prepared to do this but I will return the item recorded delivery for a refund. They said this is not acceptable.
Does anyone know if I can do this as a Chargeback on my Debit Card as I have receievd defective goods? I have sent some papers back to the Building Society they sent me for undertaking a chargeback.
Any thoughts or encouraging words would be appreciated

Can you explain why the manufacturer would not deal with it?
Are they saying it isn't under warranty?
Do they require paperwork from the seller?
Or is it that they will only deal with the original buyer?
It's not currently clear why the manufacturer won't obide by the warranty.0 -
they told me to refer this back to the retailer - to be honest i think the seller should refund his dodgy goods. i contacted th ebank and they seemed helpful enough. all it has done is confomred to me that ebay is no good any more and to stay well away - and as for paypal - well my words are censored.
maybe one option would be to pay the seller a visit as i have his address0 -
Why are you asking for a refund?
Would it not be reasonable to get it fixed?
In law if you buy something you have to allow the retailer the chance to fix it, you cannot just demand a refund (although some shops will refund out of goodwill).
The manufacturer only has a contract with the person they sold to.

Sorry - but under UK law you are not automatically entitled to a refund.

I think you should pursue your rights and regardless of what ebay and paypal do you DO have statutory rights.
I do however think arriving at his address (especially without notice) is quite confrontational and is not necessarily going to get you a good result.
It's not clear whether you have given the seller the chance to fix it.
Why not write to the seller (recorded delivery) asking them to fix it. Give them 14 days to reply after which time you will pursue it in the small claims court.
This may be enough to get some action.
Bear in mind that if you do go to court then you will need some evidence that it's not working if you want to win your case.
It doesn't have to be from PC world, but you will stand a much better chance if you have some proof otherwise it's just your word against the sellers.0
