Does a private seller have to tell buyer it was a CAT D?

Evening all,

My friend is selling a CAT D car shes had it for 3 years and had no problems with it but now thinking of selling and doest know if she needs to tell the buyer this information, I mean she knows the damage it had and she had it repaired (by my dad whos a mechanic)

I've got no problems with cat D cars myself having had a lovely one that i traded in, they arn't dangerous.

But anyway as a private seller do you have to pass this information on? And does a HPI check show this information on it?

    It would show up on a HPI check.

    If she is asked, she has to answer truthfully however there is no legal requirement to volunteer the information. Cat D applies to cars which haven't been in accidents as well.

    As Hammeyman said, if asked about it directly you must answer truthfully.

    I remember a courier mate back in the mid '90s, he was going to sell his weekend bike to go on travelling.

    It was an expensive bike, but had 3 grand owning on the finance.

    When he was talking to the eventual buyer he was asked if it was on finance, to which he said yes, then the bloke asked if he was going to settle it, he said, nah, I'm going to take the money and goe the Australia travelling, with laughs all round.

    The pillock only paid the £7000 for the bike and my mate headed to Aus, not been back to the UK since.

    Apparently the buyer turned up at the garage where I worked, and had viewed the bike, shouting about how he hadn't settled the finance.

    I had to laugh, the rumour I heard was the new owner had to settle the outstanding finance to get good title, as my mate had told the finance co that he informed the new owner that he wasn't going to settle the finance.

    You have to admire my mates front, though I did feel sorry for the bloke that bought it.

    Experiences like this are why I am careful when buying anything that may have been on finance.

    I would only buy a cheap car, sub £500 without a HPi check, another reason why buying from auction and only buying main dealer trade-ins is sometimes safer than buying privately.

    It'll be worth less as a Cat D - if you're advertising it as market value for a clean car and not informing the buyer of it's history than you're as bad as this bloke

    Put yourself in the buyer's shoes. I know if I was coming around to look at a CatD that'd been honestly described I'd be quite happy with that, but if the fact had been concealed from me, and I ran an HPI check (which I always do, and which any sensible buyer always does) which uncovered the fact, I'd run a mile. Not because the car was a CatD, but because I'd been lied to.

    Your choice really.
