reclaiming insurance payout

Hi folks,

2006, i wrote of my mothers car in an accident. I was a driver with no licence, no insurance and did not have permission to drive the car.

I was prosecuted for Dangerous Driving, driving otherwise in accordance and no insurance. I was not prosecuted for TWOC.

My mothers preferred insurers basically sent a letter stating they would only pay out if they could then reclaim their costs from me. At the time i agreed to pay them approx £5000 at £100 pm.

I have now paid approx £3000 towards this.

My question, Are they entitled to take this money from me? Do i have any leg to stand on with regards to ceasing these payments and reclaiming my money?

My thinking is My mother has paid a premium to insure her car, it was effectivley stolen and they pursue myself for the cost of writing off the car. Would they be able to enforce this?

    Yes I am. Pay the insurance company back every penny that you agreed to pay them, that's the right thing to do. And maybe you could learn to show a little remorse.

    No reason why they can't pursue you to reclaim their losses.
    Usually it's not worth it as the thieves have no assets. You have, and you agreed to pay.
    Whether they should have paid your mother on not as a condition of you paying is another matter.
    The two shouldn't be linked, but you all agreed at the time.
    She could have pushed for a payment without you agreeing, the insurers could have taken you to court for damages.
    The police could have been persuaded to look at charging you for TWOCing, so all in all, it seems a fair result considering.
    (If you do stop paying, as you have proved you can, they will most likely persue you for the remainder though now)

    Yes i am totally to blame for what happend, infact i could have easily died in said crash due to the severity. I have shown remorse towards the people ui let down, my mother.

    Cheers for your advice anyway starry, looking forward to the next time i have to ask a random for advice.

    I didn't instruct you to do anything. I just thought it might make people more inclined to assist you if you at least expressed some regret for what you did. There was none whatsoever in your original post.

    Car insurers are putting premiums up through the roof at the moment because of the cost of claims and many people are struggling to afford to keep their cars on the road, so I hope you'll understand why I don't feel inclined to help you avoid paying back what you owe.

    skylinelover - where you under 18 when you signed the agreement to pay back the money? Contracts signed by minors are not enforceable IIRC.

    I did not feel the need to express regret 5 years down the line as i have had my punishment in the way of fines, points and extortionate insurance premiums, all on top of a criminal record and paying at least £3000 back already.

    Maybe i took your post in the wrong context and i do apologise.
    Please though, in future if you dont feel inclined to help then maybe its advisable to just back off and keep out.

    Hi,

    I was 19 at the time but i do not actually recall signing anything. Would it be worth my while contacting the insurer to ask for a copy?
