Injury claim - quick question

    £3300 for whiplash is a lot... would be interesting to know who the third party insurer was

    MY misgivings were proved wrong, my solicitor got back to me yesterday and after negotiation the claim was settled for just over £3300 which with the additional £300 cash back on top is certainly above my earlier expectations.

    I have said this quite a few times on here but my OH has had 2 compensations claims and both were over the 3 grand mark.

    My Brother had one claim of £3,600

    My Friend got £3,100 , her Hubby got £3,900

    All were injuries lasting up to a year and were ONLY for injuries (i.e NOT loss of earnings etc)

    Oh now thats very interesting. I have a claim going through against them at the moment and they seem to be very much dragging their feet. Hopefully this means I'm going to get a half decent offer... and soon! I've had enough of the dam pain in my shoulder :mad:

    By way of valuation, can you confirm how that £3,300 was made up? And if it was solely damages for your injury, do you know whether or not a lower back injury was diagnosed as well as the whiplash? It may help others as a matter of clarification, because whichever way you spin it a simple ten month whiplash injury is not worth £3,300. Which tends to suggest three possible explanations; the award is for more than just the injury, the diagnosed injuries amount to more than whiplash, or the insurer has settled at a higher level of general damages to ensure savings in relation to costs.

    I think the middle option is more likely, though obviously if everything points towards the latter option then that is something that is interesting indeed.

    I know you keep mentioning this, but I promise that for 12 month whiplash only those values are all outside the guideline levels. Which is why I'm curious as to whether the OP can clarify the above questions, so that we can get some way to figuring out the reasoning behind a settlement that, on the face of it, is actually too high.

    It seems that compensation payouts are getting a little on the hign side , I do agree. I have no problem what so ever with the people genuinely hurt receiving payouts but what about the people with their fraudulant claims.....surely if it continues our insurance is going to increase even further! :mad:

    I have heard of a quite a few (genuine) people getting compensation claims recently and they were ALL just for injuries and they were ALL above £3k.

    Makes you wonder why these companies are paying these amounts out instead of the guideline amounts.

    it all depends how quick you settle. i had a crash over 2 yrs ago. after 6months i went to a consultant and he said your injuries should be cleared in 6 months time. i wasnt desperate for money so didnt settle.

    after 6 months i still had symptoms, so went back to consultant, he said should be cleared in 4 months...... so then insurance company offered over £4000....this was a yr after the crash.

    Im well over 2 yrs after crash, i 'just' have whiplash, thought its quite bad at times, been back to consultant after 20 sessions of physio, and consultant basically said i dont think your symptoms will clear up. my solicitor told me hes hoping for me to get £8-10k just compensation. not including gratuitous care, loss of earnings etc...

    anyway, what im saying is, you dont know how bad your symptoms will get...mine were ok for 6 months then after 6 months came down on me like a tonne of bricks! dont settle 'early' unless your desperate for money. the doctors arent always right.

    the bigget benefit for 'waiting' was the physio, as that came to over £1000, and i would be in far more pain without it!

    I agree with the last poster . To be honest I wonder if whiplash pain ever fully settles...My Husbands first accident was August 2008 and the pain was still evident on the odd occasion by the time he had his SECOND accident!

    Infact , as his job involves sitting driving all day , theres still days when he wil come home of an evening complaining that his neck and shoulder area is niggling.
