Tesco Misprice Error - TV stand

On Saturday I purchased a TV stand in good faith for a flat screen TV from Tesco Direct it was £28.99. It seemed like a very good price but not totally unbelievable. This evening (Monday) I received a phone call from Tesco Direct to say that my order had been cancelled due to a pricing error. I accepted this.

However, I then went back onto the Tesco Direct website and the item was still £28.99! I phoned CS and they said that earlier today the item had been listed as out of stock, however for some reason it had now come back into stock. No real explanation as to why this should happen. So I purchased it again. It seems fair enough that Tesco might have made the error in the first place but for the error still to exist seems ridiculous. A lot of people will still be purchasing this item in good faith.

Please let me know your thoughts. I actually need and really want this item.

It's a strange question. You say "A lot of people will still be purchasing this item in good faith". Er, yeah, like you! You've bought it again! Have they sent another mail saying your order's been cancelled, because it's on at the wrong price? What is the true price? Mistakes do happen with pricing, and the company's entitled to cancel the order (provided the contract's not been completed). TBH, I'm not completely sure what you're trying to ask.

They haven't yet cancelled my second order. I purchased it again because I wanted to make a point. The point being that Tesco's should correct their pricing before cancelling my order. I understand that companies have a right to cancel orders due to pricing errors but surely their is an obligation on them to correct the error (and within a reasonable time)? How long does it take to correct a price? Surely it is just a 30 second job? The lady I spoke to on CS said that she would have done the same in my situation. She also mentioned that she had dealt with a couple of calls about this item earlier today. The true price of the item is around £160 but I genuinely did not know this when I purchased it originally.

You know its the wrong price but have purchased it again. It will of course be cancelled again so why waste your time? They are allowed a reasonable amount of time to change it, the person on the phone will not be the expert needed to do this. It will take time for the customer service agent to email the correct department, then they need time to work through the huge amount of emails in their inbox, and then it will be sorted.

I would say that time passed earlier today. It takes a few seconds to change a price on a web site.

    Similar experiance with J.Lewis.

Their 'back in stock' email showes a TV at £499.99 instead of the shelf price £800.

I questioned them over it and nobody could give an explanation. Had to chase it for a cpl of weeks and put up a bit of a fight but in the end I did get it at the lower price.

2 weeks and a day later get another email....still showing £499!

Unfortunately I feel that point will be lost amongst the 40 odd million people who also shop in Tesco.

I'm not a legal expert at all (so apologies in advance for any errors/oversights), but...

I understand that it's a common mis-understanding that a (physical) shop must sell an item at the advertised price. That's not true (unless the contract of sale has already been agreed), but the shop must take "reasonable steps" to correct the pricing error as soon as possible.

I'm not sure whether it would be "reasonable" to expect Tesco to correct the price on their website immediately, or whether you would have any right to buy the item at that price - I suspect that you don't have any right (unless the contract of sale has been agreed), but Tesco may be breaking the law because they have not taken the steps necessary to ensure that further customers are not misled.

If the pricing error has not been corrected within a reasonable time and your second attempt to order the goods is rejected, I would see what Trading Standards have to say.
