Problem With iSmart Consumer Solutions

I have a couple of problems with iSmart.
Firstly, I've been waiting over a year and a half now for iSamrt to deal with a PPI reclaim.
It was a joint loan taken out with my wife for home improvement and was repaid 18 months in when we remortgaged. The finance company contacted me directly with an offer about June last year for less than half the amount of the PPI. I forwarded this offer to iSmart who then sent me acceptance forms. I queried why the offer was less than half when iSmart had promised at the time I would get the full amount back. They said they'd have another look at it and promptly got back to me sayin the offer would be rejected. The case has been sent to the Financial Ombudsman and I was got the reference numbers at that time.
Since then I've heard nothing but contacted the Omsbudsman today who told me that in September 2010 they were informed by iSmart that an offer had been accepted and they closed the case.
I'm sure that I did not sign any offer nor even agree verbally to accept anything.
Secondly, my wife had PPI on a loan. Again nothing happened until she contacted the Ombudsman directly who sent informed her that an offer had been made but iSmart had not informed us of this. She got acceptance forms from the Ombudsman, signed them and sent them back and she is currently waiting for this to be paid.
So my questions are, in the first loan, iSmart appear to have accepted an offer without our permission though nothing has been paid or come of it. Have they breached their contract with us by doing so?
In the second loan, again, it was up to my wife to arrange acceptance, have they breached that contract?
Both these complaints were given to iSmart in February 2009 and there have been nothing but problems since. iSmart constantly lost paperwork or sent our the same letters over and over again. Im very close to complaining about them to the Ministry Of Justice.

If it was me i would complain to the ministry of justice without delay.
I would also file a complaint with ismart and request your file of papers so you see everything they have done in the matter.0 -

WHen you agreed to let ISMART deal with this for you did you sign anything that said that they were allowed to have the redress sent over to them and they take their share and pay the rest over to you? Was it perhaps that they have taken their share of this amount as payment for their services?
I would perhaps get your case together first and then get onto the MOJ after having all your facts because it seems a little vague as to what has happened to your money. If you did not accept or receive any money then perhaps the FOS need to investigate the matter deeper as they are just taking the firms word for it that they have settled your case and without proof (as you state you received nothing) this is not really fair as ANY firm could say that.0 -
Oh Dear! I am just about to enter into transactions with them. Don't know that I will now. I hve not signed the forms they have sent me so I dont think that I have yet entered into a contract.

Omg this company is useless! I have been waiting 3 years and they have never contacted me i have phoned them countless times and always get the same answer 'we are doing a bank chase'. Do they actually know what they are doing? what angered me the most is when i said i wanted to cancel and go with someone else they said they would charge me! For what! They haven't done anything in 3 years! I would advise everyone to avoid this company there are plenty more that would help you.0

They cold called me last week and told me they represented the Ministry of Justice (alarm bells immediately started ringing), but I stuck with them just to make sure.
Sure enough they claimed I have a PPI claim outstanding ya-de-ya-de-yadda.
I have never had any PPI, I've already checked myself so there's no possibility that I've ever appeared on any list of people who might have claims outstanding. (And I wouldn't use one of these rogue organisations either if I did)
Anyhoo, it concerns me that they are passing themselves off as representatives of the MoJ.0 -
Just had a lengthy phone call from a female call operator from this company. She started off by asking to speak to me - and rambled of the company name which I asked her to repeat several times.
She said it was a PPI claims company and would run a 'free check' to see if I had been mis-sold PPI. Apparently 80% of people have been mis-sold and it's likely I would fall into that group...I told her I had not been mis-sold and I was fed up with the constant barrage of texts and calls from such companies who I have never heard of acting as middle-men to reclaim monies for me.
I said I was not interested but she refused to give up on the call. It continued for 27 minutes in fact - more because I wanted to try and coax information out of her. She tried to claim they work with the Ministry of Justice and I could check their number online - I did and according the MOJ website, they did NOT appear! I asked if they were approved by the Financial Ombudsman to which she replied: "yeah we work with all of them too!" She said my details had been passed to them from a third party and I said I wasn't willing to discuss my personal and/or financial information over the phone with a complete stranger.
While talking to her, during which she seemed to insult me and my intelligence several times, I ran checks on the company and reviews and came across this site and an article run by Watchdog which quite clearly state not to entertain this company. I put to her the comments of the Financial Ombudsman which said I can do these checks myself and she just then changed tack to say "how will you feel in 5 years time when you look back and could have got £3k-£5k? - bet you will have wished you had done this then." My answer was simply, "I do not have any mis-sold PPI to claim as I told you at the start". She then said: "For god's sake, when you are sat doing nothing, watching tv or something, you could instead be filling out the form for us to reclaim for you - then you won't live with that regret! It's people like you who can't be bothered that will lose out!" I told her she had now insulted me and the conversation was over. She tried to backtrack, apologise but I stood firm and said I no longer wished to speak with her and wanted her to remove my details from their system.
I have checked further into this company and have found cases listed where they have never delivered what they promise. She also said their fee was 25% when it seems it is more like 30%. They are also alleged to have closed unsettled files and kept monies sent by the banks and charged
I am sick of these companies ringing me on a daily basis, not to mention the constant texts that come through saying I'm owed XXX amount which I know are scam texts.
The only person who will explore whether I have been mis-sold PPI will be me. Steer well clear of these companies!0 -
I started a couple of threads in other forums on the back of this, basically wondering if it was viable to collect the numbers of the usual PPI cold calling suspects and add them to a block list on my Android phone.
It seems to have worked with the few dozen numbers we collected and I've not had a single call come through about it in the last month.0 -
Before reading these articles, I entered a cliaim with I Smart in Dewc 2012.
Any communication received has only been forthcoming after I chased!
Finally this morning I sent a terse email referring to the "bad publicity" on this and other sites - lo and behold, within an hour I received a telephone call from them. Not much help though with comments like they are still waiting for the lender to respond!

Maybe you should learn to listen before you post on threads like this.
they don't say there representatives of the MOJ, they say REGULATED by the MOJ which is fact.0
