Housing Question

Hi, i hope someone can help me out with my friends problem. Her husband has recently received a community payback sentence due to his threatening his daughter with a knife and physically abusing his wife. He is registered homeless and staying with a friend at the moment but has started pestering my friend to either sell the house or get a mortgage to buy out his half. She does not want to sell the house as she is currently living there with her 14 year old daughter and she cannot get a mortgage as she is on income support. The house is jointly owned by the two of them and has no mortgage or loan secured on it. Thankyou in advance.

    A court won't order her to give up the family home uintil the daughter leaves home then it can make an order to sell. For the next few years she'll be safe leaving things the way they are.

  • If knife threats are involved, then why on earth hasn't she taken out whatever an injunction is called these days to keep him more than a million miles away from both of them and forbidding him to so much as breathe in their direction, much less hassle for money?

  • She stays put, she contacts a solicitor to sort this out. She will likely stay in the house until the daughter is of age, unless it has ten bedrooms or something.

    while I appreciate what he had done is bang out of order he needs to be able to move forward with his life too - obviously he should be paying child support but with no fixed abode he is less likely to be able to get a job to get the fixed abode and support his child where as if they sold the house, your friend could use the money as a deposit somewhere, the husband could do the same or rent somewhere, and will have the means to be able to support the child.
