Received appeal papers for DLA Tribunal - What now?

I'm new on here and hope that I've got the right place to ask this question.

Right, I applied for DLA with the help of the CAB.

Weeks went on after they sent the form off then I had a letter saying that I didn't qualify at all based on the form and reports from my GP.

So I sent in the appeal leaflet as CAB could not help with the appeal as they don't have the staff anymore to take on these things.

Then I got a load of papers for the Tribunal. That was on Friday.
I didn't open them until today as I knew it was bad news and didn't want it spoiling my weekend.

Anyhow, I have now opened it this afternoon and had a look at what my GP has said.

There is a DBD370(N) GPFR form.

Diagnosis *******(full details shown of all illnesses)
History - very little known/not attended surgery for 2 years.
Variations - line through it
Clinical findings - line through it
Treatment********(full list of all medication taken)
Disabling Conditions - lines through all of them.
Any further information that will help - left blank.
Signed by my GP.

Where do I go from here? No I don't go to the GP I get my medicines all on repeat.

Haven't seen my GP for 2 years as not much more that she can do. Before that, I was seeing consultants for this and for that, had operations. I am now left unable to do most things and can't get about for pain.
I just stopped seeing consultants about 2 years ago as well as I was getting fed up with being treated like a baby and a guinea pig.

I genuinely have a recognised condition which does cause all sorts of problems with looking after myself and have limited mobility because of severe chest pains.

I don't get any benefits because I haven't paid any stamps for years. I lodge with a mate and have done for years.
My mum and dad help out with rent, food and clothes from charity shops and e bay.
I don't drink or smoke or do any type of drugs before you ask.

How can I tell the DWP and the court that I am bad even if my GP doesn't have a clue about me?

To be honest you haven't got a cat in h**ls chance of proving anything without backing from your GP.
There are many on here that have the same problem.

Maybe someone else can suggest something to you, but I wouldn't hold your breath.
As a matter of interest why have you not seen the GP before now, why stop seeing the consultant and surely your GP is still not prescribing the same drugs week after week, month after month for two years?

I can't believe your GP is prescribing you tablets without regular reviews.

I'd go and see your GP and then go from there.

Then after you have got everything sorted I'd seriously think about changing GP's because I wouldn't trust a doctor who doesn't insist on regular reviews. Even for asthma we are called in every 6 months for a review. Until we have had our review we can't order any more sprays on repeat.

When is the tribunal? I can't believe that you haven't seen your GP about your illness/condition for 2 years! If you are having so much trouble with your condition WHY haven't you seen your GP, and please ... why did you just stop seeing your consultants - did you just decide one day ... I'm not going anymore? If you weren't happy with them you should have discussed any matters regarding your visits with them!

If you have been on repeat prescriptions for 2 years WITHOUT a REVIEW with your doctor ... that is very bad!

If you knew you were applying for DLA and from the forms you know that they may contact your GP, you really should have gone to see her/him! If your GP has no idea of your condition and from their records you haven't been to the surgery ... they are not mind readers!

Even if you haven't paid stamps and you don't/can't work you should have applied for benefit. You lodge with a 'mate' - don't you contribute to rent, bills etc? It's unfair on your parents to pay for your keep as an adult you should surely be taking some responsibility about sorting your life out? Sorry if I sound harsh, I am wondering your age .... as you seem to be taking advantage of family and friends.

You need to visit your GP and take those notes in with you, and you need to explain to your GP what has been happening!

I can't believe you are asking .... as someone who doesn't communicate with their GP!

    Thankyou

It is only because I have been told on here that you should contact the GP. I don't discuss my life with my GP, but I do go if I have a serious relapse, or something happens that has me worried!

This is yet another case it seems of people not bothering their GP's for a social chat about their everyday life - just like me!

I don't know what is wrong with this person, it can't be that bad. On the other hand I will agree that the same can be said about me.

As for my situation as you have brought it up, I claim ESA only. I intend to claim DLA, not because I want it, but just to prove to myself that the system fails those that aren't in regular contact with the GP. This poster is an example of that happening. I do wonder how many people there are in the UK that fall into this void?

So it looks as though I have a big big problem then. I did wonder that.
I don't know when the court case is, they have said it could be 6 months.
I don't see the GP because I have the medication which seems to help. I used to see the consultant and he said that there is little more that can be done other than taking the pills to stop some of the pain. It will get worse every year but there is no cure. He told me that he could do this and could do that, but couldn't say that it would work. So what is the point. If he doesn't know what else to do who else does? So I didn't stay around long enough to find out what it was like to be a guinea pig.

No, same goes for the GP, no point, can't do anything. I get my medicines every month. I have three pages of repeat on my script. Various types of painkillers, etc No, I never get called in to see them. Just hand the script in wait two days and pick up a carry bag full from the chemist.

Put it like that, yes how can they know, but they never asked me to go in either.

I'm 43, haven't worked since I was 23 when all this started. At the time I was homeless when I was taken into hospital. They wouldn't release me until they knew where I was living, so I have stayed with various mates since then. Moved on when I couldn't stay anymore.

I can't get benefits. Mum and Dad have tried for me. I have no stamps for past 20 years. Don't have a permanent place to live so can't get anything. Wish I could go home, but there is no room in there 1 bed sheltered flat.

So who will pay for my food, lodging money and clothes? Do you think I want it this way? Being ill as bad as me is one thing, but being homeless is another.
This is what I have for my life, I don't blame anybody. My mate told me about DLA as it doesn't matter about your stamps with that one. He gets it already.
You having a laugh? take what in to the GP? As if they will do anything, don't think so!

OK I was only asking about this as my mate has let me use his laptop.
It doesn't matter, I was just hoping for a bit of luck. As I see it, you don't get hurt if you don't expect something.

But thanks everyone, you have answered the question, I'll leave it at that.

    Thanks

Income related ESA doesn't rely on past NI Contributions. You should apply for this. Get yourself sorted out with your GP as they will ask him for a report.

You will need to see GP to get a certificate to say you are not fit for work to get the ESA ball rolling.
