Bank are unable to locate a copy of signed agreement

Hi All,

I have recently requested from Lloyds TSB credit cards copies of all statements and original agreement when i took out the credit card as i was looking into claiming back PPI. Today I recieved statements back however the covering letter stated "Unfortunately, we have not yet been able to locate a copy of your signed agreement. We can assure you that before we opened your credit card account we would have required sight of a signed agreement. If you take this matter further, we are confident in our ability to be able to prove this."

Now this to me sounds like they are a little woried about this and wondered if anyone has had a simular situation and what can i do about this could i request all payments back that have ever been made on this card? Any help would be greatly appreciated.

    What has that got to do with claiming back PPI??

    I'm not sure how you've drawn that conclusion? It reads to me as "We know something about defending mis-sold PPI claims that you don't know...yet". ;)

    Seeing as the courts have confirmed that they dont need to supply a signed copy, what gain do you think it is for you?

    You don't need any copy of the credit card agreement to claim back PPI.

    Are you wondering about the enforceability of the whole account? You could have a look on the debt free wannabe forum re this, but anyone who has stopped paying due to not having a valid CCA did not get the payments already made, back.

    As Dunstonh and jonesMUFCforever states the banks only have to provide a like for like copy of the agreement if your trying to get your credit account wrote off and dont have to provide one at all where ppi is involved.
