Lloyds TSB Over Limit Charge notice period

I have just been charged a £12 over the limit charge even though at no point did I go over my limit and nowhere on my statement does it show that they plan on taking this charge. I phoned up and they have put the £12 back in my account or will do within in the next 3 working days, My main question is do they have to inform me in some way that they are going to take a charge from me, I was under the impression it would be on my statement so I would be able to know how much to pay in but that just showed the interest.
