Gadget Insurance wont pay out!!

My son took out insurance for his iPhone4 from gadget-cover.com, which covered him for loss/theft. They have declined to pay out saying "lack of reasonable precautions taken to not lose his phone" He was in a restaurant and the phone was in his jacket pocket which was on the back of his chair when he last had it. He was told that if he had left it on the table he would have been covered!! How can leaving it on a table be better than having it in your jacket pocket??
Trying to contact these people is a nightmare!! When he first rang them to make a claim, he was on hold for nearly two hours only to be told he couldn't make a claim via the phone. Does anyone think they should be paying out?

Well it was left unattended, unlike if it was on the table in front of him. So he didn't take all reasonable precautions to ensure its security, thus leading to the phone being lifted. The circumstances would have been different if he had been wearing the jacket and had the phone on his person, or in his view.
Phone insurance is for mugs. if you feel a need to have it, it is a reasonable indicator that the phone is beyond your means.My farts hospitalize small children
