If they deemed that you have been living together for all the time you have received HB/CTB you should provide evidence of your partner's income for this period as if you would have qualified for benefit under your correct circumstances they will use the benefit you should have received to net down the overpayment for the benefit that you shouldn't have received.
For example if you have an overpayment of £500 but you were entitled to £100 as a couple your overpayment will be for £400.
Are you going to declare that you partner has been living with you?
Hi G
I was aware of HMRC and notional offsetting but didn't know LA do as well. In a sense it's making it quite alright to fraud benefits, an example of 2 people on benefits claiming separately but living together wouldn't incur an overpayment due to being entitled to full HB anyway..........Forums can be/are a good guide to entitlement and it is good practice to back it up with clarification from the relevant department/specialist with written confirmation to safeguard yourself.0 -

the ball rolling by ringing the tax credits hotline!0 -
ok thanks for advice, anyway I've cancelled single claim now and informed them of partner has being living with me.....
So you have been a couple for 6 years, living together for four years, he has been working for that entire period and presumably supporting his family financially and you have been fraudulently claiming all the benefits your greedy, grasping hands can get.
I hope they throw the book at you.
Personally, I'd suggest you give the gravy train a rest and manage on your partners wage alone.0 -
congratulations on getting through!
must be some kind of record!!!!!0 -

It is. My personal opinion is that people get away with fraud too lightly. In some cases it is just an overpayment which isn't really a deterrent as it's like a shot to nothing, what do you have to lose. If it were up to me there would be much harsher punishments and prosecution should be a given.0 -

really is a shame that the I.P addresses of the blaitant fraudsters can't be given to dwp on here, my god the drop in spongers would be an overnight success with what get's said on here.
Op start writing your list of what you said to whom, you will get caught
The DWP could apply for a court order to compel the forum owners to give them the information.Gone ... or have I?0
