Leaving a tenancy when no deposit / rent paid and no contract signed!

Hi,

This is a weird situation. I have been living in a shared house for coming up to 2 months. I'm not happy there and have found a great place to move to.

My current landlord has asked for no rent / deposit and I haven't even seen a contract. I have asked for details to pay rent to and so far nothing.

For the sake of karma I will pay rent up to the date I leave (28th march). Am i expected to give a month's notice though as I have signed nothing / haven't even spoken to this Landlord verbally or on email (apart from asking for account details). I have only dealt with one of the current tenants?!

Where do i stand?

    Could you clarify whether you're paying rent or not - you say you aren't then you say you will.

    Usually, just because there's not formal written contract does not necessarily mean that none is in place. One is generally deemed to be created at the very moment rent is paid and then a month's notice coinciding with the rent-day would be due to the landlord.

    You need to exercise some care if you decide to not pay rent or give the landlord proper notice as they could expect your other sharer/s to pay the shortfall. It just depends on whether this is important to you. Have you tried to contact the landlord about paying rent/giving notice?

    Hi,

    I haven't paid a penny to the landlord yet. I have asked my housemates on several occasions for his details. They just think it's funny. I finally got the contact details and have emailed my landlord asking where i need to pay rent to but so far nothing. He lives in India so apparently he can go awol from time to time.

    I completely expect to pay rent up to now and to cover them for a month if need be (they're nice guys so I don't want to leave them in a bad position) but the lack of communication is worrying...

    Your other housemates could be subletting and therefore know that you're not going to get a separate contract from the landlord. Jut pay any monies due over to them and then go.
