Internet contract advice please

I want to cancel my internet with AOL and move to Sky Broadband.

They stated that i took out in May was for 18 months, so effectively, it finishes in November 2011.

They want to charge me £100+ for leaving as i have to pay for the remaining months of the contract apparently.

There have been 2 charge increases during this time, from £14.99 to £17.99, then from £17.99 to £19.99

I have not given my consent/agreement to the new pricing change, which i explained to the woman on the phone (obviously, i want to try and loophole to get out of paying the remainder of the contract), and she stated that they sent out an email on each occasion, stating i had 14 days to cancel.

Is this legally binding? If a company sends out a document and that person does not reply within 14 days, effectively means the company can do whatever they like?

Any advice would be great.

Thanks all.

It sounds above board to me. On each occasion the price increased, you were informed and given 14 days to cancel your contract otherwise it would continue as before. You didn't cancel and so it continued, this is standard practice.

Should of cancelled when you were given the opportunity. By doing nothing following their email notifications you've deemed to have accepted the new T&Cs.

Thanks for the replies - just seems a strange way - i.e. if you do not reply within 14 days then it automatically is legally binding.

If a company sends you an email informing you of a change, and if that email tells you that you have 14 days to object to the change and you decide to do nothing, then you are deemed to have accepted the change.

I notice you didn't say that you did not receive the email. ;)

If they send out an email giving you 14 days and you didn't reply and they then cancelled your service, they'd have even more people on here complaining!

I'm sure there's a precedent for "silence does not equal acceptance"
One important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.

You'll probably find it was written into your initial contract, that this could be the case. So there was no 'silence' since you agreed to it in advance.

I guess you need to hope there's another price increase :p
