Alternative Role Offered

Just a quick query - coming near the end of my 90 day consultation with no consultation :)

There is one job being ring fenced between two staff - hence one has to go.

The new job description is over 10 pages long!! and has a huge work load and as I've just been off sick with an illness that is going to take time to recover. i feel i would like to work part time rather than full time now.

My first ideal would be redundancy, which i have asked for at the start of the consultation and they said it was too early to decide and redundancy was not an ask.

However, I am going to ask for it again at the meeting at the end of our 90 day consultation. If they don't offer me that - can I say to my employer that I will apply for ring fenced job but now want part time due to my illness rather than full time - my work colleague he wants the job full time due to family commitments and will apply.

However, he is also applying for jobs, my concern is that if he gets a job and leaves before the notice period, they will slot me into the new structure and I don't want that.

Any advice gratefully received.

    You don't have to agree to the job, and they can't just "slot you into the new structure". If the job isn't suitable they have to let you go, if they do they open themselves up to an unfair dismissal claim from you. If they want to avoid that they have to make offer redundancy.

    Ahh right thanks for that. I was slightly worried as another colleague in a similar position - had a colleague who went for early retirement and was slotted in to that ring fenced post.

    They can't just change your role/job description without you agreeing to it first.

    however if the job is quite similar and you refuse it then you can be deemed to have resigned = no payout. You need to look at if it is a reasonable match to your current job or completely different - is it 10 pages outlining what you do now in lots of detail or is half of it totally new?

    Its really the two posts made into one so quite a lot is new about six months ago all my work was taken off me and put in the new one. My old job spec is only three pages long - this is 9 pages long with lots of new stuff so a new role and new job title but same scale.

    I know I posted before but I want to get all this sorted out before my meeting in April - as you can imagine it is a worrying time so need to know everything ready for the meeting.

    But unless you add something new the suggestions won't change.

    Go back and read the old thread if there is something you need explaining ask.

    Apologies for going over what seems old ground but the situation changes every day - you'll understand that this forum has been fantastic as i am getting no help or consultation during the 90 day period - - My main concern is that now colleagues are being slotted in to new roles which have been ring fenced and i dont want to be in that situation - I just need to make sure that I am 150% ready for that meeting in April - its going to be hard hence why I need as much information as possible so I dont get screwed!! If you excuse the expression as I have a feeling they are going to be very sneeky.

    I feel like I am going into a game of poker and having to have all my cards ready to put on the table.

    The key is to identify why it is NOT a suitable alternative if you don't want any job offered.
