Rights on returning video games

Hi all,
Just wondering if anyone knows what rights we have concerning the return of video games. Basically I bought test drive 2 last week and it's annoying the hell out of me because it's buggy and constantly crashes. The whole purpose of it is for online play and the servers are constantly down. If downloaded the mandatory update (xbox by the way) and it's still just as bad. Am I entitled to an exchange for another game at least? It's simply not fit for purpose

I don't think any gameseller accept returns unless the disc is faulty (I assume that it works fine when not online?). You can not return it because it doesn't work online.Estate Agent, Web Designer & All Round Geek!0

Depends when and how you bought it. If bought online/mail order and still within 7 days then you can return under the DSRs and they cannot argue. IIRC you only have to notify them of your ~intention~ to return it within 7 days.

Goods which cannot be returned under the Regulations include:
Perishable items, such as flowers, fresh foods
Items that have been made to the customers specification or personalised
DVD’s, CD’s, computer software or electronic games if they have been unsealed.
Newspapers, magazines and periodicals

If bought from a shop, I would try taking it back and asking for a full refund, especially if the packaging makes claims that aren't fulfilled. Ignore any special refund\swap schemes they might have and concentrate on statutory rights.0

Ah yes, I didn't recall that exemption. I guess it's going to have to be under SOGA then - but that will always be a fight to prove that it is the game at fault and not how the OPs PC and/or broadband connection are configured...0 -
Looks like it would be a good idea to just say that it doesn't work then, ie. that you can't get to play it, rather than getting too specific.0
