Estate Agents' Contracts

Hi

Can anyone please advise on EA contracts? We signed up to a 16 week contract, which now has expired, do we need to give 14 days notice as we now wish to go with another EA? We have tried to read our contract but it is a bad carbon copy of the original contract.

We would like to advertise with a new EA now, but don't want to risk paying my existing agent a penny if we can help it.

Our existing EA is a total disgrace and we highly suspect has been working for our buyer instead of us all along. They got us a buyer and it took them six weeks to get the survey done, then a further 10 days to get their mortgage approval. Their mortgage company has given them approval for the full price with no retention but the buyer called me direct to say he wants me to pay for a more specialised survey and any work suggested from this as his survey mentions damp in our property (nonsense). He admitted it was mentioned as a minor and was a very general comment no specifics. This was the only negative on our survey. They buyer still has yet to start any searches and it is nearly 8 weeks since we accepted his offer (£5000 less than asking price)

Our EA has made excuses for the buyer all along and does as little work as possible. They want this second survey to go ahead and are trying to say we won't have to pay. They also admitted to our solicitor that our buyer is a BLT one even though every time we spoke to the buyer he stressed it was for him and his wife only as they needed to move out of the family home. We know our EA also does more lettings than sales!

The last straw yesterday was the EA yet again refusing to put our property back on the market and saying we shouldn't call him anymore and he will call us when they have any news. This is really outrageous as we have never called them more than 3 times in a single week and have always been polite.

We really can't believe the crap we have gone through we this EA. We fully believe we are being set up to be Gazundered

We have emailed them yesterday to say that the buyer has two weeks to exchange or we put the property back on the market with a different EA.

    Why email them and then ask for the advice? I would instruct them in writing to put it back on the market within 48 hours and if the didn't, i would consider this a good reason to sack them. Job done.

    Giving notice is determined as per your contract. We can't answer this for you.

    Make sure that you ask the EA for a list of people they consider they introduced to the property so there can be no dispute later on.
