deceased persons debts and child benefit

Sadly my sister passd away last week, she was 66 disabled living in rented accomodation and no will,no savings.

She has 5 children - 16 - 30 years old, and she divorced many years ago.

Who if anyone is responsible for her debts, credit card, loans, etc?

The 16 year old is at college - so child benefit continues till 18 - so who claims it?

    The child benefit would normally go to them.

    But there might be some extra help or benefits available too...I expect somebody will come along who knows.

    I'm sorry for your loss.

    Your sister's debts won't be passed on to anybody-somebody will have to let the creditors know that she has died without assets. Again, I'm sure someone here will know the correct procedure.

    Probably his older brother, his dad is still around even tho' he and my sister parted many years ago - I don't know if they got divorced or not.

    But its not quite as simple as that - his dad spent time in prison (3 1/2 years) over a violent incident - not I stress my sister or any of her children. Would that preclude him from taking custody of my nephew?

    One thing I have found out is that banks, etc will try it on to get debts repaid - you just direct them to take it from the estate - and as there is nothing of any value in my sisters estate there is nothing they can do - or at least thats what a quick google seemed to say.

    when nan died, all her debts died with her. Yes various companies did write asking for their money. But they was all told there was no money. I had to send a copy of death cert to some i recall, and for others I had to fill out a form simply stating there was no estate. Pretty simple and striaghtforward tbh. The most persistant one was the local council wanting rent (she was on HB) council tax for the property( she was on CTB) and over £1500 for removing a sofa and a cooker I couldn't move in time. But they was also told you can't have it as she didn't have it. Nan died on the Saturday of a bank hol, so the earliest we could notify them was the Tues, but we did it on Wens as that was the day we registered the death so had the cert. They wanted the keys back on the Friday!!! Hence the reason for them demanding the rent.
