Old Account,DCA & Bank charges

I was with HSBC whilst I was at uni and in the end got into a bit of a financial mess to say the least.

I know that I had a lot of bank charges/overdraft charges/credit card applied to me at the time....but I no longer have the statements or account details.

The account was closed down and then handed over to a debt collection agency - and I paid off the outstanding amount to them about a year ago.

Will I still be able to claim those charges back even though it was referred to a collection agency and basically I have paid off what they said I owed them? Also I have no idea of a/c number or sort code is there any way I can trace back to my account?

    Yes, you can still claim!

    So far as I know you can issue a subject access request under the data protection act without giving an account number, although they will probably have to hunt around a bit more for your details and it will therefore take more time. If you have moved address since holding or settling the account you may be asked for proof of identification.

    If you paid DCA fees or had a default / negative info placed with credit reference agencies as a result of this debt, and the debt at the end could be claimed to consist entirely or mainly of 'snowballed' charges, you might be able to get the fees reimbursed or the entry removed from your credit file.

    Sorry if I am being a bit stupid, but how on earth do I start the claim...

    do i ask HSBC to trace my account first at my local branch or just go straight for a request for statements. Also who do you write to? IS it their head office or should I just go to a branch?

    I have changed address so many times, I know my address when i registered for the bank account and where I was living when it closed....will they need anything else do you think?

    Also, I had a current account, loan and Credit card with them - will I need to send off for individual statements for each of those? and pay £10 for each?

  • i have just been sent 6 years worth of bank statements and it didnt cost me a penny.the bank has offered me half of my bank charges as a good will gesture,but not accepting that their charges were unlawful,im persuing it further as they are more than £1000! i followed the proceedure outlined on fools.com,and sure enough, everything mentioned about the bank on there has happened.
