you need a financial settlement to assign debts as well as assets.
Again I suggest mediation as a cheaper alternative to paying oodles in solicitors fees which will do no one but the solicitors any good...
How do you go about getting mediation?

How long did the marriage last?
How much of the debt is in his name - he has to pay this.
How much of the debt was strictly in joint names - both signed proper legal agreements.
Any Council tax debt from during the marriage? If you've have not made a mistake, you've made nothing0 -

Any Council tax debt from during the marriage?
2 and a half years when they split up, none of the debt is in his name and no council tax debt. This is a system account and does not represent a real person. To contact the Forum Team email forumteam@moneysavingexpert.com0 -
In which case, legally he could claim that the house is a joint asset, particularly since he was paying all the bills during the marriage. The normal limit for a short marriage is 2 years. |SO the house could come into the equation when making the finaical settlement.
If the money that was borrowed was used to buy stuff for him, he really should pay that back, morally. She may even be able to prove that was spent on stuff for them jointly, even if it is holidays etc.
Why was he paying £100 per week to her?If you've have not made a mistake, you've made nothing0 -
The 100 per week was to help her out with electric etc as she was begging him for money because she is out of work and has no income. This is a system account and does not represent a real person. To contact the Forum Team email forumteam@moneysavingexpert.com0
