I think that's a pretty reasonable description of most DCA's isn't it?
The vast majority of them are deceptive and dishonest and make empty threats which seem very convincing and scary to the uninitiated.
They almost without fail will threaten legal action against unenforceable debts as well which in my mind is their biggest sin.0 -

I think you will also find that many of the people who they are trying to recover money from are also deceptive and dishonest. It goes with the territory.0 -

The difference is that DCAs lie for a living.
Presumably you think that it's also ok for the police and the courts - who regularly deal with the deceptive & dishonest - to be deceptive & dishonest themselves by virtue of it 'going with the territory'.0 -

That 's like saying all defaulters are thiefs then?

I can see why debt collectors do this to be honest. Banks know they cant enforce debt as they hadnt chased it up, they sell it for a ridiculous (?spelling) amount to debt collection agency, they also know they cant enforce it but its worth a punt....after all it probably only cost them a few pence....I bet if you read the letters they send out they are probably just within the law, they dont have an obligation to inform you of your rights not to pay and I am sure the bank has not broken any data protection rules (why not ask the data commissioners) by selling on the debt, some people will pay up...after all they are "offering" the chance to pay off at £3 a week, some will ignore letters, some will know they dont have to pay up. I presume (because they continue to do this so therefore must be profitable) that more people pay up than dont0

Hi my name is john george wardle. !i have for the past 4 months been in dispute with llyods tsb regarding a few accoutants i.e loans and credit cards. Heres the best bit i am not nor have i ever been a customer of llyods tsb. It works out that there is a john c wardle of the exact same d.o.b that is a customer of tsb. So i somehow got linked as this person and i now have this persons defaults on my credit files plus i have every accoutant he has had an i can see previous addresses of this guy who actually lives in sheffield. I first found out about this in january by recieving a debt letter threw the post to my address in liverpool. I contacted the debt company to explain that i had never had a credit card from tsb which they where great help an put a hold on the debt till this was resolved. So i contacted tsb to tell them the situation but a week past an nothing was done. I was giving refernce numbers an was told people would call me back but nothing ever came. So i rang back and i was told to print off my credit files an take them in to my local branch with identification of myself. So i did that an i got no help what so ever i was told to go to citzens advice. So i came home an phoned tsb back up and they said the bank manager should of rang the approiate depertment to resolve this matter which she didnt. So i put a complaint in about the service i got from her. So 2 weeks had past an i still heard nothing back from tsb. So decieded to ring back to see what was happening and they had no record off me phoning and was basically accused of lying prentending to be this person but lying saying i wernt him. As you can imagine i was very angry and i collected all my eveidence and went back to my local branch where then i seen the bank manager who was of no help then. She reconised me straight away an i told her that she had to photocopy my identification an fax it off. So that was done and i returned home and i waited for there reply. As you can imagine i got no reply so yet again i was on the phone to them again. I gave them the job number off the fax and to my surprise they couldnt find the fax. I was totally disgusted with all of this by now i was seriously suffering with stress from it all. So i told them that i will be writing a letter stating that you have 20 days to resolve this issue or i would be contacting my mp and bbc watchdog. So a week later i recieved a letter saying it will take up to 6-8 weeks to look in to this matter which was not acceptable at all. Because i have not been able to apply for credit and me and my partner where looking at buying a house but have been seriously hamperd by this plus my partner has been seriously ill the past 8 months and she should not be going threw this at all. !!!So i decieded to ring them last friday and was told that they had sent a letter out saying that they have offerd me £550 compensation £250 towards costs and £300 for stress tottaling the offer of £550. Taking into accoutant that i have to pay all the credit agencys a monthly bill since january to keep them open till i see that these defaults an links are removed from my files. So the £550 is disgusting consedering the stress and anger and my time constanly chasing them to fix this massive error. So i was told they would think about this and contact me this week. So i thought i will contact the financial ombudsman to see what help i can get and was told that i carnt get help because i am not a customer of tsb. So i contacted the information comminsoner office an they where extremmley angry about what tsb have done. They want me to document everything that has happend an sending it all to them. So my partner called tsb up and they said they wernt offering any more compensation and it will take 6-8 weeks to remove all of this off my credit file plus they say they had no records of my calls for the past few months To which the information commisoner said this is wrong an should be removed straight away. I am now worried incase this john c wardle now has accesess to my credit history and now exposed to fraud. So tsb have sent the cheque out without me accepting it an just waiting on it coming threw the post. I am lost as to my next step to take an i would really love somehelp and guidance on this. I really look forward to a responce from yourselfs. !Thank you!

Hi there,
My mother recently received a letter from a debt collection agency. They claimed that the TSB had sold her debt amount to them and that they would accept £3 payments a week they also mentioned it was debt from the year 1999. Now, I knew that if a debt is owed for longer than 6 years and that the organisation had not followed the debt up (which they hadn't), that my mother was under no obligation to pay the debt back, which they reluctantly admitted after 10 minutes on the phone.
What I'm wondering, is if my mother had no obligation to the debt (because it was 12 years old), that if the TSB broke the law by passing on her details to a debt collection agency and selling the debt to them? (wouldn't this be a breach of privacy and/or the data protection act?)

The bank have not done anything wrong in selling the debt on to a DCA.
However as the debt is 12 years old I can imagine the debt would be statue barrred now.Im an ex employee RBS GroupHowever Any Opinion Given On MSE Is Strictly My Own0
