replacement Iron now broke after 10 months

I had a Phillips GC4640i steam iron £79.99 from argos 18 Aug 2008
it broke and was sent to an approved Phillips repair centre on 29 March 2010 under its 2 year guarantee.
After lots of chasing the repair centre deemed the original iron beyond repair and suppiled an new Phillips GC4641i steam iron as a replacement on 17 May 2010.

The replacement one has now broken after only 10 months usage.

The repair centre states its out of the original 2 year guarantee (18 Aug 2008) and theres nothing can be done. The replacement iron (17 May 2010) also has a 2 year guarantee but the repair centre states that the original guarantee is the one to use so I will have to pay for it to be looked at repaired.

Is this correct? I was looking re sales of goods and fit for purpose, as its broken after only 10 months, but I cannot find any relevant bit re replacement goods becoming faulty. can any one help please

thanks

It's correct that the warranty stays at the original start date, otherwise they could potentially be liable for eternity if the item keeps breaking just before the expiry date and it is reset.

I am aware of that and agree on its principal

however the supplied item, brand new in box has broken after only 10 months. It too had a 2 year guarantee and would stand if I had brought it.

Does it mean its not fit for purpose, or can I not go down that route as it was supplied as a replacement for the original Iron ?

Its broken inside its guarantee, after a short space of time, although outside the original irons guarantee if you get my drift.

The gaurentee runs from the original iron so the new iron takes it's place. It is as far as they are concerened out of gaurentee. You could now try and get recourse direct from Phillips for the new iron but as far as Argos are concerened you have had over two years out of it and they are no longer responsible. This too could be debated as it would be reasonable to assume it should last more that two years, but that is another argument.

I bought an iron from Argos that broke within 12 months, still had the receipt so Argos exchanged it for a new one. This new one only lasted 8 months, and again Argos exchanged it.....don't know what I do to irons but I thought it might help you!

OP, perhaps look at it this way...

In Aug 2008 you bought an iron.

You have had an iron now for two years and seven months. Ok, not the same iron throughout, nevertheless use of an iron for that time.

You should be talking to the retailer who sold the thing to you... Argos.
You might like to discuss with them whether an iron should be expected to last longer than two years and seven months.

    Good luck.
