What I cannot understand is if you went in with the sticks and went through the check list of what you can and cannot do, how with your condition did you get turned down?
Are you taking meds?
Did the Consultant say your condition was temp or permanent?
What is your prognosis? Did you get supporting evidence from your GP, OT, Physio and NS?
Armed with all that, even if ATOS dismissed your claim and hearing judge and panel should/would take this into account. Your details are sketchy at least.0 -
Well today they took my car back. I feel totally gutted. I'm going to see if I can get a lift to the CAB to get some help. I can't afford my own car as I'm only in receipt of IB so now it's going to be extremely lonely on my own! "Friends" have already stopped texting etc, just goes to show.........I pray to God that I don't go back on that slippery slope again,it's damn hard when you have no-one to help you. I've got the local MP trying to help me but at the minute they're in recess so I have to wait. Who will pay my deposit if it gets re-instated though?! It's not going to be me! The bloke who came for the car couldn't believe it, he thought he was collecting it as I was swapping into a new one. I have absolutely no faith left now and no fight left in me0

How bloody dare you say I'm just trying to get my own way,how rude. I'm 39, can't have kids because of the damage to my back, am in 24 hour pain and my idea of "getting my own way" or "manipulate the system" is not trying to kill myself. You have absolutely no right to judge me, you don't know me and you ought to be ashamed of yourself. If you've got nothing constructive to say then don't say it at all. These forums are not for spiteful people like yourself, they are for people like myself who have been let down from the hospitals to the government and are at a loose end as to what to do next. Yes, I did have all the hospital evidence,yes, I did have notes to say I'm waiting to see a specialist, yes, I'm taking meds and yes, it's permanent because the hospital left it too late to operate on when they did. I know there are discrepencies in the statement of reasons and hopefully something can be done about it0

My Paper hearing for my Higher rate DLA is this afternoon, I don't feel hopeful atall. This is my second Hearing. This time I have a Letter in support of my claim from my GP, but the DWP's DM, ignored this letter and refused to reinstate my DLA, claiming their doctors report is the only report they will accept. The doctor that came to my home spoke mainly to my children, asking me to lift my arms above my head, which I tried to do but could not due to the severe pain in my back,neck,arms. I have Fibromyalgia, raynurds,arthritis,split pubic bone,severe lower back pain as a result of an epijural leaking into my spinal coloum, asthma and chronic aneamia. I also suffer from Agrophobia and depression. My health has gone down hill and the stress of begging for my DLA to be returned has helped in this worsening of my health. I am housebound now. the doctor the DWP used must work on a commission. Why do we have GP's if a stranger can diagnose you without knowing you or your medical history? This failure to take onboard my own GPs letter of support surely means they think he's a liar along with me!0

Though too late for you, as I understand it, it's in some circumstances possible for the tribunal to come to you.
Paper hearings have a much lower success rate than oral.
