Car Insurance Help!!

Recently I was was involved in a non fault collision. The driver accepted liability and my insurer was contacted. Due to the value of car and cost of repair its considered a write off. I received an email from my insurer stating that my car is a Cat C write off since 2007 which was news to me. I purchased a HPI online which confirm what my insurer had said. I currently have a courtesy car via my insurance and they have not invalidated my polic (yet!), eventhough they do not insure Category write offs. My question is 'Where does this leave me?' HELP PLEASE!!

Cancel your claim and make it directly off the third party insurers.

Thanks Quentin. A friend also told me to do the same. What Im concerned about is if i did cancel the claim through my insurer would I have to pay them for coutesy car and/or other expenses they may have incurred??

You may (though could maybe add the courtesy car costs on to your claim off the third party) - but from what you say you aren't going to get any of your claim paid by your insurer, so this seems your only route!

they should not invalidate your insurance as I have never known and ins company ask the question during a sale (phone) if the car has been a previous Total loss (internet might be different)

If they deal with the claim they would make an offer based on the the fact the vehicle was a previous total loss. Have you got the V5 and is the prev loss noted?

Thanks vusys1. I have my insurance through swiftcover which is all online based. They have requested a copy of my V5 which I have and it does state 'Substantially repaired and/or accident damaged; Identity checked 20/.02/2008'

The Ombudsman would expect the Insurer to pay the write off value excluding the fact that it had been a previous write off in the OP had bought it without knowing it was a previous write off.

Swift have a disclaimer saying they do not accept cars that were previously written off so Quentin is spot on with cancelling the claim and claiming directly from the third party.

Note the third party insurer are allowed to take into account when valuing the car that it has previously been written off

Thankyou to everyone who submitted information to help me in my situation. Mucho gracios
  • I would just like to add, as you had a credit hire car, you will kindov be responsible for the repayment. if you get any letters demanding payment simply forward them to your solicitor. or let your solicitor know about the credit hire that you have had.
You wont have to pay them but it will be added into your claim by the solicitor, if the credit hire dont get paid they may contact you after a year and ask for money, and if you have settled your claim then you will have to pay them yourself.
