P800 Tax underpaid.

    You need to state - a little more clearly - the under or over payment for each of the years. I can't work it out from what you've posted.

    Where you receive P800s for several years together -it is the final one (07/08) that shows the net figure owed by you / payable to you. As they carry forward the credit or debit through each of the years. Note 15 or 16 on the final year P800 should show the overall under / overpayment - if that makes it simpler (as on the Notes you have)?
    If you want to test the depth of the water .........don't use both feet !

    upto 6/7 you have overpaid tax of £575.00

    the tax you were due to pay in 07/08 was 763.

    because of the overpaid tax from previous years being carried forward, the amount of tax you had to pay in 7/8 was £188.00.

    you actually paid £978.00 in that year, deduct from that the £188.00 that you had to pay and that leaves a credit balance of £790.00 which is being repaid to you.

    As no calculations for later years have been issued, it means one of two things, not all the information is there in order to automatically do the calculations and they will be looked at manually, or you have paid the correct amount of tax for the year, and no refund/bill is due.

    Well I got some new information today - HMRC have applied a new tax code to recoup the underpayment despite their investigation being uresolved and ongoing and despite their promise that repayment would NOT be sought until the investigation is complete.

    I rang HMRC today who informed me they wrote to the pension provider in June 2011 asking why they had failed to operate a tax code that HMRC issued in 2007/08, HMRC informed me that the pension provider had failed to respond.

    I rang the pension provider who informed me that ....

    1. HMRC issue tax code notifications to them electronically - so nothing gets lost in the post.
    2. HMRC never issued the alleged tax code during the year 2007/08, so there was nothing for the pension provider to action.
    3. Pension provider offered to write to us confirming that no such tax code was ever issued to them.

    Pension provider says the fault lies fully with HMRC for not acting upon the information that they had and failing to issue a tax code in good time.

    HMRC says it issued the tax code and the pension provider failed to action it, however it cannot conclude its investigations until the pension provider confirms why it did not action the code (that never arrived).......

    Confuzzled.

    Oh for the love of fluffy bunnies, I'm quickly loosing the will to live over this situation.

    Today we got a letter saying we had to fill out a self assessment. I rang HMRC to ask why?

    HMRC - because there is an underpayment from 07/08 and by filling in a self assessment it makes reclaiming the underpayment easier for us.

    Me - so how does this years self assessment relate to 07/08?

    HMRC - oh we dont want this years, we want you to file 07/08 so we can reclaim the underpayment.

    Me - OK, so you have finished your investigation into my appeal?

    HMRC - no, we havent had a response from your pension provider, we wrote to them twice and they didnt answer us so we are proceeding to reclaim the underpayment from you.

    Me - is that reasonable given that you havent completed your investigation?

    HMRC - thats not for me to say.

    So, I phoned the pension provider to ask why they hadnt responded.

    Pension provider - because HMRC havent written to us and nor did they issue an ammended tax code for 07/08.

    I think their website says I only need to keep records for 22 months after the end of the tax year - in this case until Feb 2010, yet they want me to file a self assessment for information they already hold, confidently enough to issue a p800 only to enforce repayment of something which is still subject to an appeal.

    I get the feeling that they are ignoring the appeal completely, the pension provider say they have had no correspondance from HMRC, HMRC havent updated me on the investigation, each time I ring they say there is nothing on their screen other than they are awaiting info from the pension provider and so they just proceed to reclaim the underpayment.

    Any advice?
  • I went to see my MP at his surgery once over a tax dispute...one letter from him sorted it out...worth a thought

    A quick non update.

    Nearly 11 months since we wrote appealing the p800 and todate we have not received any updates of how the investigation is going.

    I wrote and made a formal complaint, sent it using the track and trace service, it arrived at the tax office three weeks ago - no response yet.

    Will update when something DOES happen. Again thanks for all the support and information you posters have given. x x x

    For all of those who took the time to offer advice, support or just a kind word of encouragement on this post and also via pm's.

    Today we got a letter which said.

    "Thankyou for your complaint dated December 2011. I am sorry it has taken so long to respond to you. We have considered your complaint and we will no longer seek to reclaim £1014.38, however £58.00 remains outstanding which we intend to collect."
