Well real shops are different from the internet in that in a shop, offer (of money by customer) + acceptance (from stores employee) = contract.
Online the precise point a contract is formed depends on the T&C's. Most companies have it so a contract is not formed until the goods are sent - even if you receive a confirmation email as these are generally automated where upon sending the goods, a employee has reviewed the order and "accepted" it.
However in this case it is more than likely covered by SOGA as "not as described". Meaning they are entitled to their money back or a replacement but the retailer can favour one remedy over the other if the other is disproportionately costly.
You will likely find that the warehouse (or where they send the goods from) receive a reference number for the item/s that has been ordered. Its doubtful they would receive a picture along with a description of the item/s that has been ordered. The retailer could then argue that they accepted the order based on the item reference - which corresponds to the gaming pad and not a keyboard and thus that they didnt actually accept the order for the keyboard.
I am by no means a lawyer or judge. Just applying my own logic to the situation. You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0 -
Hi Guys,
As many of you will be aware the Logitech G510 Keyboard has been mis-priced on our websites and we are aware of this issue. It has now been taken off our sites to avoid further confusion regarding the price.
In this instance we have spoken to the distributor as it was they who made the error and it has been agreed that any genuine orders placed will be honoured. The Delivery expectations given to you at the point of purchase may not be met, so you will be contacted by letter with a new date in the next 3-5 working days.
If anyone has a specific query regarding their order they can contact us at network@VeryHQ.co.uk where we will be more than happy to help you with your query.
We apologise for any inconvenience caused.
