Default for £2 !

Hi

Just checked my credit report, and i noticed Nationwide had defaulted me for a unused account for the sake of £2.00 !

Can they do this?

This is going to mess up future renting applications for me.

Does anybody know who to write too? to try and get it removed... the account does state satisfied?

    Did you ignore their demands to pay the £2 for 3+ months? Did they send you a formal written default notice providing you with 14 days to pay the £2? Did you pay within this 14 days?

    The account has been closed since Aug as settled.

    The default was in July.

    I cant remember getting anything in the post requesting £2!?

    In that case the default has been recorded in breach of the Data Protection Act.

    Write to the address recorded on your credit file under "Profile Information" for Nationwide.

    Do a print screen and copy & paste the entry from your credit file showing the default into the letter you send to them.

    Say that you never received any notice of arrears or notice of default, either electronically, written, or verbally, and were therefore never aware of a debt.

    State that as well as never having been made aware of a debt, you were also not provided with an opportunity to pay.

    Explain that defaults tell other creditors that a debtor has failed to respond to repeated attempts from the lender to bring the account up to date. They did not attempt to get you to bring the account up to date, so the data is misrepresentative, defamatory, and therefore in breach of the Data Protection Act.

    Close by stating you exepect the false and defamatory data to be removed within 30 days save your complaint being referred to the ICO and compensation saught.

    Should be gone within a month or so of them receiving the letter from you.
