Then he needs to be forced to use the CSA. Your right about a pointless exercise. They will know who is complient and who is not, there could be ways of getting around.
The CSA tarr everybody with the same brush and its not fair. Compliance should be rewarded (for want of a better word) with leniency and understanding.
I will say though that if we have to pay to use the CSA then i expect a top notch customer service not the mish mash of case workers who have had no training, dont understand the procedures and lack of accountability. They will not be dictating the rules the way they have if your paying for their service. We would not have it from Tesco so also same applies to CSA.0 -
Chapter 2 para 10 states on the gateway and progress to statutory system:
"Where the parent wishes to pursue [that] and states clearly the reasons why, the conversation about other options available will be closed and they will be assisted in moving to make a full application. As stated above, we envisage this would be the case for instance where the other partner is refusing to engage at all, or has failed to keep a previous arrangement between them, or where there has been separation due to violence or risk of abuse"

Totally agree with this, and what a dreadful waste of all that money and time to put all those DEOs in place, are they going to chuck that all away?

Well it says that victims of DV will be fast-tracked and won't have to pay ..... but how will they monitor this? Will these poor women (yes, I know men can suffer too) have to prove it with police reports, photos .... I mean, it's just a bit degrading really. My ex husband had me up against the wall with his fist in my face but never actually hit me, so would I get away with citing DV or is it ok to be abused mentally or be threatened with being hit, but not physically be hurt? I can't prove it, so would I not be believed? My DH is one of those who have no contact. We thought that it would all be done in writing. We are on the electoral roll and we now live in the same house as where DH did when he lived with his Dad years ago. We are easy enough to contact and find.
My DH is really quite dubious about a private agreement as there are trust issues with the PWC in his case and he is not convinced that if he paid the money she would admit to it being CS and he would end up paying twice. How would that be proved. I thought about an Email receipt. The CSA dont take a S/O for CS as proof. If the PWC said he has not paid, how can it be proved. He is wondering whether to just pay the CSA and then its all above board. Trouble is that with a 20% surcharge for collection it will take his liability to nearly £75 a week that not including any charges for the calculation, which is out of the question, we cannot afford that.
I suppose im for it more because im also a PWC but have a private agreement which has been going for nearly 10yrs. I dont get nearly the amount the CSA calc says but am happy to settle for what i do get so as not to rock the boat. My ex lives in Spain now too so even less likely if i fell out with him.
I dont know what we will do really. We cannot do anything until the PWC decides what she wants to do.0 -

I think its 12%, for 1 16%, for 2 and 19% for 3. With the same deductions for children already in the family. Pension payments are deducted too within reason. They closed the loophole for excessive pension payments.
Iv another question too - The PWC has at least 2 least CS cases. Is she going to have to pay separately for both or will they be lumped together. Could get pricey for a PWC who has multiple fathers but cant find anything which clarifies. The 1st ex has no job so very little child support. Would she go after 2nd ex as a safe bet because he is compliant and has a decent job and pays £300 per month but not bother with 1st ex as £5 per week hardly seems worth it when you have to pay £100 to apply in the first place.0 -
I don't know the answers mum24boys but I suspect b. she will go after the person with the income.
So the CS amount has been dropped from 15% to 12% for one child? Do we know the rationale for that?Please do not confuse me with other gratefulsforhelp. x0
