2 CSA Cases

HI
I currently pay for 3 children with 2 ex partners.
1 ex refuses to come to an agreement between us but the other is happy to.
If I come to a mutual agreement with 1 ex will the csa take that into account when they work out what the other one should get or will they take the full % for 1 child???
Any help would be appreciated

The CSA won't take account of a private agreement unfortunately. To have consideration given to other children you need to pay for, you need to have both cases through CSAOlympic Countdown Challenge #145 ~ DFW Nerd #389 ~ Debt Free Date: [STRIKE]December 2015[/STRIKE] September 2015

No, they will ignore your private agreement with the first - you need to get them both via the CSA.0

thanks for your reply, I thought they were trying to get people to come to agreements between themselves, it just seams silly that they would not take 1 agreement into account when doing there other one.0

It's a silly rule and I wonder how it will work when the new CSA rules come into effect - where you have to pay to set up a CSA case.
So just because one ex is unhappy the maintenance paid to the other ex will also have to be handled via the CSA - resulting in an unecessary fee to set up the second case.0 -

I completely agree! A real shame. Before long though when the system changes, the ex who won't agree with you will have to pay to have CSA assess you. That might be enough to persuade her to come to a private agreement. Hope the other parent isn't too put out by having to go to CSA because of the other mother!Olympic Countdown Challenge #145 ~ DFW Nerd #389 ~ Debt Free Date: [STRIKE]December 2015[/STRIKE] September 2015

This is the situation I am in - ex and I had a amicable private agreement but as his other ex used the CSA I now have to be paid via them or my children would not have been taken into account.
Bit peeved really that I am going to be charged for using a service I neither wanted or needed.Smoke Free since 03/08/20090 -

The fairest thing to do in these circumstances I guess is for the NRP to apply to the CSA rather than you and for him to pay the fee, as it is his other PWC causing the issue. Or I guess you could agree to pay half each. Hopefully they will make provision in the scheme legislation for cases like this and things will become clearer after the consultation has closed in April.Olympic Countdown Challenge #145 ~ DFW Nerd #389 ~ Debt Free Date: [STRIKE]December 2015[/STRIKE] September 2015

You can have both cases through the CSA, and then the ex who you have an amicable agreement with can ask the case to be 'Maintenance Direct', so you would pay them privately, and the other ex through the CSA.0 -

I agree. Unfortunately we're in the same situation but as the NRP (I'm the NRPP). One ex will have to pay as she will insist on using the CSA and even though the other ex would be happy to use a private arrangement we'll have to set up another CSA case. It wouldn't be fair to make her apply (and pay) so we'll have to do it. And that's not fair on us - all because one PWC is a crazy old bat :rotfl:0 -

Well the good thing is that fees and such like aren't being introduced until the new scheme comes in next year, and if you open a case now then it would be at least 6 months after the new system comes in before they would close current cases...so opening a case now wouldn't lead to any application fees at all.0
