Car accident claim and voluntary excess

I am flumoxed!!
6 weeks ago i gently nudged a car from behind (:o....rain, early morning monday)...anyway i accept responsibility, though I could not see any damage. I gave my details to the woman and finally I got called by insurer today. Repair cost at the garage £33.1, but she has also claimed her voluntary excess!!!!!!!!!! £250!!:mad: how?? why?

so the total her insurance company is demanding is £283.1....who gets £250 and why??? it is £33.1 isnt it????:mad:

    I think your insurer need to check a few details

    Did the third parties repairs:

    Total £33.10 or Total £283.10 (and she had to pay the first £250 of the claim)

    If the total damage was only £33.10 it wouldn't of been a viable claim under her policy as it would be less than her excess and would just be submitted as an uninsured loss which would of been recovered from your insurance.

    Repairing the damage you caused cost £283. This was paid in 2 separate instalments (£250 by the innocent victim of your negligence and £33 by their insurance company).

    The garage got the lot!

    And now you (or your insurer) must pay up for your negligence.
  • I asked the chap (my insurer) atleast 5 times..."what was the total cost of repair" and he said £33, but then added "she has decided to claim her volutary excess aswell"....

    I waiting for the paper work....if the total repair is £283 then I understand, not if its £33!!!
  • Hi, Firstly I would like to say insurance is there to pay anyloss as a result of your actions.
    The exxcess is paid to the insurance and once the funds are recovered the excess is given back to the insured.
    What I would do in your situation is work out if your insurance will go up if your insurance pays the £33.
    If so pay a check of £33 to the third party insurance so that your insurance dont pay, and inform your insurance to close the file as you are sending a check for repair. As long as the other side are not injured then you wont have any other comebacks, but if they are then you can tell your insurance to pay.

    Hopelessly wrong.

    The "guilty" party (the OP) is liable to pay all the costs the innocent party has incurred! This includes the uninsured loss of the innocent party's excess.
