Section 21 advice

Hello,
I am currently renting a property which my step dad owns, which he needs to sell as soon as possible.
We are on the council housing list and are hoping to buy a shared ownership house which is being built at the end of this year.
The council have advised me that in order to get 'bumped' up the list we need to provide them with a Section 21 notice from our landlord.
Neither me or my step dad have a clue where to get one from or which one to fill in (a or b??)
We have a formal tenancy drawn up but there is no time period on it. He originally bought the house for me to rent to help me out 5 years ago but I'm now in a position to get on the property ladder myself. (unfortunately can't afford to buy the house I'm renting!)
So if anyone can tell me which form I need to get, and where I can get it from I'd be very grateful!

All tenancies have a length. It can be zero days, but they have a length. Please explain exactly what was signed and when.0

Hi thanks for the reply so quickly...
I will have to dig out the tenancy agreement when I get home from work, but I'm guessing we would have signed for 12 months then rolling after that.
It was just to satisfy the mortgage company in the first place so I have to admit I didn't pay much attention to it.0 -

So you're homeless right? Hmmm. But in a position to buy a (shared ownersip) house?
Most councils require not just a S21 but a court possession order.0 -

As I said, if you read it properly, we have been renting from my step dad for the last 5 years, and we're now in a position to buy our own house, and now that we're on the list for a shared ownership house my step dad would like to sell the one we live in.
Our local shared ownership houses are given out on criteria. And although we fit the requirements (ie less than £60,000 income, have lived and worked in the village for 5 years) according to the council a section 21 notice from our land lord would also help.

Sometimes councils will say that they'll bump you up the priority list if a s21 is served, when they mean that they'll bump you up the list if you've been evicted by a court and are homeless.
I'd be tempted to ask the council to put in writing that a s21 would help you.0 -
If you are now on a Statutory periodic tenancy ( following the expriy of an original Fixed Term ) then your LL would need to use a S21 (4)(a) Notice. Once a full two months' worth of rental periods have then elapsed the LL would be able to apply to court for repossession.
Your rental periods are governed by how often you are bound to pay the rent (am assuming monthly) and will have been running on from the day after the expiry of that original Fixed Term agreement ( that may or may not tie in with a Rent Due date) So if original contract expired on, sa,y the 15th of the months each subseqent rental period will have been running from 16th of one month to the 15th of the following, even if rent gets paid on 1st of each month.0 -
