Environmental Health - noise

We`ve had an offer accepted on a house. I have no reason to doubt the vendor who said noise has never been a problem but I see no reason why I should`nt check with the environmental health anyway. Better to be safe than sorry and all that..

I`ve read on this site that the environmental health hold details of any complaints made for five years.
Last wednesday I rang my local council, the EH is a dept within the council. They took my name and details, said somebody would call me back but they never did. Today, a week later I rang them again. I explained what I was hoping to achieve and got passed around from dept to dept, I spoke to four different ppl altogether. Nobody seemed to know who I needed to talk to.
The final person I spoke to said that they can`t give out the info I require as it may 'descriminate' somebody. He also said that files would only be kept if they had actually prosecuted ppl. I said so complaints could have been made and then dropped half way thru or never followed up fully and they would`nt be on file as nobody would have been prosecuted, correct. I was eventually given an email to mail stating what info I am trying to find out. A couple of the ppl I spoke to said that complaints may show up on Land Charges and that this is something I need to instruct my solicitor to do. Other ppl said that details can`t be released because of the data protection act

The council employees were all very polite but it`s still as clear as mud right now

    If you suspect noise is an issue then withdraw your offer and move on. It's better to be safe than sorry as there won't be anything you can do about neighbours once you've bought the property.
