Had to hit and run yesterday but I'll give two scenarios to try and explain my opinion of what I believe happens re partial refunds. It is a method I have used over the years and have involved TS to see whether myself or the customer is the 'reasonable' one.
My customer purchased a laptop for £1000. It has broken and we have agreed on a partial refund.
1. I say to the customer that I could reasonably expect the laptop to last for 5 years. My customer says ' No way, I'd expect it to last for 7 years'. We then negotiate and agree on 6 years.......that is fair and reasonable.
2. My customer says ' No way, I'd expect it to last 20years'. I am not prepared to agree to a 12/13 year life so I tell the customer that we can either ask someone at TS for their opinion or they may wish to take the matter to a Small Claims Court and let a judge decide. In other words, we let the matter be decided by someone with an understanding of how the SoGA works and everything is then done ' fairly and reasonably'.
Sorry if I'm flogging a dead thread....just wanted to explain my point re what is reasonable.Justice will not be served until those who are unaffected are as outraged as those affected (Benjamin Franklin) JFT96...YNWA0
