Online company not honouring order

Ive had a look in the FAQs but still not sure where I stand.
Bought an ex display lcd tv online on Friday for £75, paid by paypal, payment completed on Friday. Stock online was showing at around 40, we received nothing to say that the TV was unavailable, however yesterday (monday) they say that the TV is unavailable (just have to check the warehouse etc) and then that it was a pricing error and they have refunded the money to paypal. The same TVs are still for sale now online at a much higher price....can we do anything to get the TV at the price we paid for it?

You have not paid for anything, you got your money back

Most companies say a contract is concluded on despatch. I suspect yours will say the same, so no contract = no 'too cheap' tv.0

As I understand it... technically it depends on whether a contract was agreed between the buyer and seller. If so, and the seller refuses to honour the contract, I believe you could sue for "loss of bargain" (i.e. the amount of extra money you would need to buy the goods - if you had agreed to pay £150 for the goods, and you can find a genuine seller who will provide them for £200, you could sue for the £50 difference).
However, if this was a genuine mistake and the seller has corrected the problem, I wouldn't take advantage of them by immediately threatening court action...
And in any case, it depends entirely on whether the vendor is deemed to have accepted the contract of sale. How much are you prepared to risk in legal fees...?0 -
Thanks guys, I dont want to sue them...just really would like the TV I bought! Do I have any comeback through paypal perhaps, as the company took my payment, and kept it til Monday afternoon...plus the TVs are still there at the new price. I think its a bit cheeky to sell it then change things after, if they hadnt actually taken my payment and held onto it for over 3 days then I would probably jus say 'fair enough!'0

Most companies dont work on saturday and sunday, So orders placed on a friday depending on time wouldn't even be considered untill monday.
You got your money back deal with it and move on stop trying to start something out of nothing. Be a different story if they didn't refund you.0 -

Hi, not trying to start anything, just have a very disappointed son who thought we were getting a new tv, buying one full price is out of the question as husband has been made redundant. the company have said that they cant supply because they dont have the stock, then changed their story and said it was a pricing error...I find the dishonesty annoying, if they had been upfront about things it would be a different matter.
Anyone any idea whether paypal would be able to do anything or would that be a wild goose chase?0 -

PayPal are useless. Anyway, what are they supposed to do? You were refunded the full amount, in a reasonable time frame, and it seems clear that it was a pricing error. If you still feel strongly about it, e-mail the company involved one last time and ask them if they are willing to make you a deal on the TV (maybe knock a tenner off) to make up for your previous experience with them.
