help needed - section 75 - goods *and* services?

I am in dispute with Nationwide Credit Card Services about several transactions made by a car hire company that were above what was agreed.

The car hire company have just confirmed that they will refund these amounts but if they do not do I have any recourse?

Nationwide claim they cannot help because the VISA rules state that, for car hire, debits can be made from an account up to 90 days after the car has been handed back. They claim this is to cover damage, fines, etc. They tell me that no signature or PIN authorisation is required. In fact, the transactions are all dated on or before the car was handed back - so there was clearly no damage, fines, etc. to pay!

Am I covered by section 75?

Surely this is theft?! How can the VISA rules say that car hire companies can deduct whatever they feel like from your card within 90 days of the end of the hire contract and you have no recourse!?

    if they are invalid, then of course you are covered

    tell them the transactions are in dispute and you refuse to pay them

    I have done!

    They requested copies of the sales vouchers.

    One of the vouchers ties with the rental contract which they have also received a copy of (however the amount charged does not tie with the contract).

    I also luckily have a confirmed quote for the contract from the broker I booked through - this confirms the amount which should have been charged. I am glad I didn't book direct as the chap at the broker has sorted things out so far - the car hire company hasn't even bothered to reply to my letter.

    There are other transacations that I did not agree to and that are from another outlet of the car hire company. Nationwide just say that they can do what they want within 90 days.

    The transactions were abroad so are done with signature, chip and pin doesn't work on foreign cards where I visited (Canada). Two of the vouchers just have the signature line blank! There is one old-style carbon paper voucher that has a bad forgery of my signature on!

    They just keep telling me they aren't going to do anything because it was within 90 days of the rental and that the VISA rules state they can deduct what they want within this period to cover damage/fines/etc.

    I have sent Nationwide several letters. The letters I have received back have been generic with printed signatures. I have had a go at them over the phone and they won't budge. I have told them that is theft and that I won't pay, they said they would reinvestigate, then they sent me the same generic letter with the 90-days excuse.

    As I said, the car hire company have confirmed last week (to the broker) that they will refund these amounts but if they do not do I have any recourse? I have received two credits today but the main one (for several hundreds of pounds) is still missing and was supposedly the first credit issued - I am worried because this credit is from the car rental outlet that made the unauthorised transactions - I suspect they have not issued a credit - the are not trustworthy.

    This has been very distressing and I can't beleive the car hire company haven't replied to my letter (send with a signature on delivery service). Nationwide have been rude and unapologetic. None of the companies involced have offered me any gesture of good will.

    Definately closing my account with Nationwide when this is sorted. The customer service I have received has been utterly useless and extremely rude.

    I have paid the credit card bill full balance as the transactions caused the card to go over its limit and they sent me a threatening letter saying that I would be taken to court if I didn't make a payment to bring it within the limit!
