Can I force my husband to sell house

My husband I split recently, I left the property to which we have a joint mortgage. The house has been up for sale since and we now have a buyer but my husband has said that he isn't going to sign the house over due to not having enough money to put a deposit on a rental property, there is no equity in house. He has also stopped paiying towards the mortgagee Can i force him to sell? I cant keep paying the mortgage without his share.

Worse case scenario is that the house will be dealt with as part of the divorce process - if it's a good sale then your mortgage lender could exercise their right to obtain an order for sale (unlikely they will but you could ask)
  • Try and sort something out as I know from experience the world of hurt, crap and loss which comes from a forced sale situation.
