Am I entitled to a refund?

I bought a new tent with my Visa Debit Card back in August but on opening it found a rip in the roof. Obviously not fit for the purpose it was bought I took it back to the shop owner who still has it in his possesion but since then I am yet to get a refund as he states the manufacture's are not honouring the warranty, and his all round attitutude to Customer Service needs a serious re-think!
Can one of you very learned people please advise me where I stand on my consumer rights cos I now hate the bloke with a passion and would like to wipe the smile off his face? Cheers!

He needs to replace or refund it! The fact he's saying it's the manufacturer fault is not really your problem as you didn't buy it direct from them but him.0

I'd be seriously tempted to march in there, demand a refund/replacement depending what you want right then or i'd call TS from my mobile right there & then. Him having it since August is not acceptable & there above poster is correct that the contract is with him not the manufacturer0

With such terrible customer service, I wouldn't be happy with a replacement.
I'd want a refund (to which you are entitled) and I'd find a tent somewhere else, from someone who has a clue about how to treat a customer.0 -
You could try the Charge Back route through VISA which has been used by farepack customers recently. Alternatively, get trading standards to have a word.0

Or inform the shopkeeper you'll take him to the small claims court where in addition to the cost of the tent he'll have to pay your fees (letters, journey back & forth, legal advice etc). Its a fairly straightforward process, and its designed around everyday people rather than overpaid lawyers - though can add a few more weeks to the resolution.
Pen him a letter (keep it unemotional) simply recounting the facts, then give him 7 days to refund you. If he doesn't respond positively you can serve papers at the court on him.From MSE Martin - Some General Tips On Holiday Home Organisations and Sales Meetings

Agree with previous poster. Write him a letter giving him 7 days to refund you. Do not accept a replacement now as he has held onto it for so long that it's now winter and you will not get an opportunity to test the goods within a reasonable time for guarantee purposes. If he fails to act, just sue him.

You are entitled to a refund if the goods are faulty dont you get some protection with your visa card:j WILL GET THERE SOON :j
