Bailiff This Morning - Stat Dec?

Well this morning I had a bailiff turn up for my court fines. Was actually pretty decent and on a level.

He told me about at a statutory declaration and to get in touch with a solicior today and sort one out.

I can get one sworn locally, but am confused as to what im actually doing.

I am on no benefits due to not wanting to be, And am sort of self employed. Basically covering expenses but no money. I only get by on hand outs from family.

My work situation is like this as I am battling anxiety and depression in my own way.

I can not afford to pay this, and im not too sure what to do. Before it went to the bailiffs I told the court fines office that I could not afford the amount they where setting up, but they refused to change it.

With this stat dec, am I get a sworn statements of my earnings? Or that the property in my flat is not mine, Or both?

Urgent help required please, The bailiff told me about this form, but wouldnt tell me more. Said he will give me a day to sort it.

    Hi - I'm sure someone can help you but what type of fine is it? is it for a speeding offence or similar? is it a council tax liability order?
    I really would not start swearing anything that is not true as well as this will get you in to moretrouble - you mention swearing that the tuff in your flat is not yours which is slightly confusing.
    Depending on what type of bailiff it is - ie what type of debt then the have slightly different powers.

    If you refuse to apply for the benefits that you are entitled to then the court will find you negligent in not paying the court fine and they will lock you up. You really need to go to court and explain that you cannot afford much but you must offer something. I am paying £10 per month towards mine they started by insisting on £50 per month and we negotiated it down to £10.

    Lock you up, we are so far away from this point it is not worth mentioning at all.

    More information on what the fine was for would help.
    I all have learnt is from others on many sites.
    Seek legal help if unsure.
    Dont pay Private Parking tickets - they are mere invoices.

    Fines are for court costs, a little bit of compensation and a few car tax fines.

    Totalling about 1200 with charges now.

    I tried loads of times to make payment plans, was sent to bailiffs before,I mangaed to get it back to the courts who set payment terms too high. I told them I wouldnt be able to afford this. And was making payments when I could.

    I have been hoping to be fair I would just get arrested for this, and then have it go back to the court and I get to speak to a majistrate and actually re sort out the fines in the fine office.

    You don't need to be arrested to go to the fines officer. Just go there on a spare day.

    There were plenty of words in the message that indicated to me it wasn't a minor thing. Court fines. Bailiff being decent. Court bailiffs seem to be better behaved than council tax bailiffs. Telling the court fines officer that they couldn't afford payments. Council tax recovery is not dealt with by the court once a liability order is obtained.

    I have spent time locked up before for not paying court fines. They felt I was negligent as I could have taken out a loan to pay the fine.

    I cant. Thats the problem. Its been refered to the bailiff company, and they are refusing to bring it back. A distress warant to sieze goods has been issued. Where as if a arrest warrant was issued it would be in the courts hands and I would get to put my case forward. Which no one from Hmcs are entertaining.

    Dont quiet get where you are coming from, but dont see the problem here.

    If a court fine isn't paid

    If an offender has difficulties paying a fine, they should contact the court. It is important an offender keeps a court informed of any changes in their financial circumstances. They should also speak to a solicitor.
    If someone doesn’t pay a fine, the court can try and get payment in other ways. These include:
    • further court hearings
    • clamping and possibly selling an offender’s car
    • taking money from an offender’s wages or benefits
    • bailiffs coming to an offender’s home to seize possessions
    In extreme cases where a person continues to not pay they may receive a prison sentence.
