Help Ex wants to move back

Ok so this is a situation a friend is in.

House in joint names, partner is in the forces and spends 9 months a year away on ops, they split 4 months ago and he has become very abusive and threatening violence etc, he is back from ops soon and wants to move back in, what powers does she have to prevent this?

He "wont" let her buy him out can she force this issue?

thanks

  • Hi,

Hopefully someone more knowledgeable will be along to answer all the above, what a terrible situation to be in. But as far as I know, she cannot force him to sell to her, but she can force a sale.

She probably needs to seek some legal advice, does she have a solicitor?

  • She must get legal advice as soon as possible, certainly before he gets back. If she can prove he is using threatening behaviour she might be able to take out an injunction.

She should gain evidence of any threats and go to the police.

They should seek mediation and agree to sell the property so they can both get on with their own lives.
