Dla medical at home

Hi I failed my Income support medical I am in the process of appealing, anyway on saturday I had a letter from medical services to say that they are going to visit me, for me to have a medical for my Dla. My renewal doesn't run out until December 2014.

The doctor rang last nite at 20.45pm to say that he was going to be doing the medical, he asked me where I live, and said he will be back in touch in 2/3 days.

I am just wondering because I failed my Income support medical is this the reason they are doing the Dla medical.

    In my experience, if DLA is going to reassess your claim early, you normally get a letter explaining why, with a form to complete. It is normally only once the form has been returned and they need more information that they send a doctor out to do a medical.

    I would phone DLA and asked them why they are sending out a doctor when your claim isn't due to be reconsidered until 2014.

    I'm not an expert and others may say different, but that would be my approach.
    I'm a retired employment solicitor. Hopefully some of my comments might be useful, but they are only my opinion and not intended as legal advice.

    Hi thanks for replying, since posting I have rang them and was told that they sometimes do this it is not unheard of.
    I haven't received a form just the letter from medical services saying that they will be sending someone to visit me.

    It doesn't appear to be anything I can do, just will have to wait for my appointment. I could really do without this, with having to appeal my income support.

    Its becoming more common, especially since the advent of ESA the DWP take the word of the HCP (who dosnt have to be a doctor btw) and the sham WCA report rather than all the information in the application form and the extra info from the consultants/GPs to prove that people are fit as lops, anyone can be cured by the WCA it seems, jesus had nothing on ATOS!

    I have to agree I don't think it is fair. I just had a phone call from the doctor my appointment is on wednesday at 1pm. At least I don't have to wait long, ds will have to take the day off from uni though he is not complaining lol.

    Very true.

    My Dad got his DLA decision last Friday.

    When he sent in the form he sent in 3 seperate reports from 3 seperate consultants and a report from his GP. He also sent in a very good report on his conditions from the internet to aid the DM into what his conditions are and the way people suffer from them.

    He was awarded HRM and LRC.

    In the letter that accompanied the decision, it says they used his application form, advice from a HCP and the ESA medical he had last October, the same medical that revealed he had 'no disabling conditions and was fit for work'. They completely ignored the reports from the specialists and GP.

    Now I know people can get DLA and be working, but the ESA report basically said there was nothing wrong with him, so how can that same report now be used as evidence to be awarded DLA?

    There is no consistency what so ever within the DWP who administer both benefits.

    Oh yes I misread that bit, I thought she was taking the day of uni.
