Advice needed.

Hi everyone,

Just wanting to ask a bit of advice. Sorry long back story.

We moved into our dream rental in april 2009. Told it would be a long term let and we could stay as long as we wanted to :j.

Cue five months later our LA turns up to do a inspection and tells us the LL is planning to seeking planning to demolish the house and build six town house on the land. Gutted was not close to what we felt. We got a years fixed tenancy agreement at this point so knew we were safe for a year at least.

The planning got turned down so all was well. We are now on a rolling contract with annoying three monthly inspections.

Now the next turn in the saga. They are develping the land next door to us. This unknown to us and we were not told when we took the house had planning already agreed on it. We were informed by phone by our LA that the LL has sold part of our garden to the developer. Her words to me were don't worry if work men are walking all over the garden as the LL has sold some of the garden to the developer (footings have to be in by the end of April when planning runs out).

Now having thought about it they are taking quite a bit of land off us. Would it be fair to ask for a reduction in rent due to the loss of garden?

This house has turned from my dream home into my worse nightmare as we never know what the LL is going to do next.

Any advice would be greatly appreciated as at the moment i can't think properly due to all the stress of the last two years.

    I think you'd be perfectly entitled to ask for a rent-reduction in view of the loss of a large part of the garden but whether your landlord will agree with you is anyone's guess. Ask away and be prepared to move if you don't like the answer. I think I'd move anyway as I wouldn't relish having to live next to a building-site.

    The terms of your contract have been changed without your consent (you've lost part of the property - the garden).

    You could:
    negotiate a lower rent,
    sue for breach of contract,
    apply for an injunction to forbid access to, or development of, 'your' land (under the terms of the tenancy)

    or move out - your time is coming anyway
