Hi I'm just looking for a bit of advice to see if it's worth speaking to a solicitor and where we go from here - if anywhere!
Hubby was made redundant a while ago along with about 30 others. Things were done a bit sloppily by the company and one of those made redundant, a friend of hubby's, decided that he wanted to pursue it further.
We did seek advice but were advised the chances were very slim as yes things weren't done quite right and to be honest we couldn't afford the legal costs if we were to have lost the case.
Now, this chap has this week won his case, which is fantastic news for him as he hasn't been able to find another job since being made redundant.
Now here comes my question and I hope I'm not going to get shot down for asking this........
As this person has successfully pursued and won a claim does this also include the other 29 who were all made redundant at the same time? or would each person be able to pursue their own claim based on this?
I'm not just asking this for hubby (although I will admit this is my main motive), but for the other people who were also made redundant at the time - some of whom we still keep in regular contact with and are very good friends.
We are going to speak to our friend and ask him what was said fully, and ask him for his solicitors details.
Thank you for any advice anyone might be able to give on this.

I don't have any law qualifications but being on the receiving end of some similar incidences...
I think that it 'sets a president' and the case (if it went to court and was judged) can be quoted by other lawyers in similar circumstances.
Isn't there a time limit on how long after dismissal/redundancy you can claim?
good luck.just in case you need to know:

Thank you for the help fannyadams.
I think there may be a timelimit and to be honest I don't think we would be able to claim, which is why I wondered whether because he's won it automatically applied to everyone, which again I doubt very much!
I am as my hubby would say 'captain bringdown'!!! I always look at the worst case scenario, which is why I usually try and find some info from this site, unlike him who likes to think he's got a chance.0 -
I think the limit is 3 months from the date the employment was terminated if you are referring to a employment tribunal
As for whether it would cover everyone, i'd always check as its equally possible that i'm wrong as i'm right but logic tells me unless they were named as collectively claiming, i dont think it would apply to everyone automatically.
If still within the time limit you could ask a solicitor if they will represent the group as a whole and what the costs involved would be. Then ask those interested to split the costs between you.
Although again, logic tells me that this would only be possible if the circumstances were the same for everyone.
Try calling ACAS or CAB (or both) and see what advice they can offer. You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0 -
thanks unholyangel.
It's been well over the 3 months, so I don't think he can make any claim what so ever to be honest. But telling him this is like banging your head against a brick wall
He was thinking that now that this chap has won it sets a presedent and may filter down to the others too, but as I've told him as he wasn't named along with his friend and it's over 3 months he probably can't claim now.
I have though told him to get the name and contact number of the solicitor who represented his friend and speak to them as they were in court at the time so know what was and wasn't said by the judge and his friend didn't really understand much of what was said other than they did pretty much everything wrong!!0
