    You keep crying fraud when there was no fraud, a correctly dated cert would have been and was presented on his return to work. The OP is at worst guilty of stupidity in trying to help his manager save time and inconvenience.

    Yes officer, I changed the cheque from a tenner to a grand, but when gran died, the money was mine anyway....

    Sadly, the lesson here is that there are some dishonest managers who are looking for excuses to trip up an employee and get rid of them. Never do anything wrong at the behest of a manager.

    I suffered a head injury at work, resulting in a fractured skull, and cerebro spinal fluid running down my nose. Three operations later, the last being to take the front off my skull, it was resolved.
    Naturally I took legal action for my injury.

    Then my Wife had heart problems again, and needed constant attention until surgery. I got a sick(?)/ explanatory note from my GP to say I needed time off work to look after my Wife. (The company insist that time off work be justified with a document stating reasons.) After handing it in (close by and quicker than post) a few days later, I was called into work for a disciplinary, where they accused me of trying to defraud them of money for sick pay I wasn't entitled too.

    I didn't ask for sick pay and I didn't expect any salary for the period, but they insist that time off work be justified, hence my sick(?) / explanatory note. (Seems to be the only form a GP has)

    p.s. After my return, they paid me NO salary the following month, with NO explanation, and nothing said. No payslip either, to say NOTHING paid.
    After my making my position clear, they suddenly turned up with money is cash form, and paid me like that, but not for the period I was away from work, which is fair enough.

    If they want to screw you, they WILL try.
    They didn't bully me out of my legal action for head injury though, which I won.

    OP as this dismissal has implications that could cost you tens of thousands of pounds in lost wages why not pay to see an employment solicitor and get some professional advice? They are the best people to know if there are any options to you and what your legal position is.

    Check your home insurance policy to see if you have legal cover. This will usually cover employment issues and their solicitor may be able to give you an idea of where you stand on this at no cost to yourself.

    How long had you worked there? Without one year's service you have almost no recourse to the law to contest it.

    You were dismissed and they have put that in the reference; as long as it's true that you were dismissed, and as long as anything else they've put in the reference is true, then they haven't done anything wrong.

    Also, you say you have since been dismissed, but not the reason why. I presume it was related? You should have contested the *reason* for it at the time, or since through an ET, but this will generally only apply if you were dismissed in the last three months, and if you have over one year's service.

  • i worked there for 3 years....the reason for dismissal was because of the change of date and the fact they believe i acted dishonestly.
    the way i see it, is that for anyone to act dishonest there needs to be the intent to decieve. i had no intention to decieve, just to supply what was asked of me in the time frame they wanted it to be done.

    as already stated by someone, i merely acted with great stupidity and after major surgery i wasnt really thinking when i done it.

    no allegation of fraud was put towards me. it was the date issued that was changed and a replacement was supplied once i was informed that what i had done was unacceptable. by this time they had already decided their course of action and this fitted in with the job cuts they were already making.

    Have you appealed the decision on the basis that your line manager requested the change and you were off sick for that period as later proved by an ammended sick note from your docter?

    Did they follow a fair dismissal process?

    I would suggest you get a professional solicitor on the case before your 3 month time limit is up if you wish to progress to an employment tribunal.

    Is your union involved? Maybe they can assist?
