Dodgy drivers and accident claims

Hi all i was involved in a car accident last year. Basically i was crossing a roundabout and a car coming from my right hit into me. I checked the roundabout clear, but he didnt have any lights on so therefore could not see him, so couldnt give way to him. When he hit me he pushed me into a car with the driver in it. The 3rd cars driver after moving her car around the corner and a few minutes later started complaining her back was hurting, but did'nt want to goto hospital. After months of not much i finally heard from the 3rd cars drivers insurance, and in her statement the only thing which was correct was that the car that hit me didnt have lights on but she didnt think it was dark enough to have lights on, the accidnet was in early october at 1930. She claims she gave way to the car from her right, my left, which i then hit into.My insurance company knows this to be rubbish as all the damage was to my right on my car. Now it would appear the car which hit me has left the country and the driver, who was eastern european, has as well.

Any advice on what to do will be much appreciated

    Was the car that hit you coming round the roundabout from your right I.E A car which you should have given way to ?

    The car that hit into me (2nd car) was def from my right, but 3rd car female driver for some reason remembers it being from her right, basically 180 degrees wrong direction! Me car 1 was hit into by car 2 which, spun me into car 3. Sorry i know some of it doesnt make sense it really is starting to annoy me as other 2 parties seem to be lying for whatever reason, how can you not remember what direction a car was coming from? And if you cant surely you should just say you dont know rather than say whats not true?!?!?!?!

    And yes you are right I SHOULD have given way to the car on my right, as the highway code states. However it was dark and he DID NOT have any lights on, which 3rd car driver backs up. I did not see him he was driving a black car at night with no lights on, and yes it was dark!!!!

  • A couple of things I noticed.
    You say the person who hit your car has left the country, call your insurance company and tell them to check on the MID for the accident date to see who was insured on the said date. They might not want to do that but if they do then you will know if he was insured or not.

    If not insured then you will have to take all the loss as you cannot claim any costs from him. If he had insurance then thats good.

    As for the letter of the claim that you recieved your insurance will be dealing with it. normally what happens is that because you hit the 3rd car you will have to pay them their loss, and then you have to get it all back from the person who hit you.
  • I think the eastern european has left the country not sure though. My insurance company tell me he definitely had insurance at time of accident. The thing thats worrying me most is my insurance know from the damage to my car that i was hit on the rear right hand side, but the 3rd party from her statment says it was from her right not my right, so surely the car that hit me would be on my left and he would have had to give way to me? I know what happened as do my insurers, i can prove from directgov that you have to have your lights on half an hour after sunset and sunset that night where i live was at 1832 and time of accident was around 1930. I know the highway code says you give way to your right on roundabouts, but as the car did not have lights on at night and his car was black how was i meant to see him.

  • If the person is insured just let the claim drag on.

    Chase your solicitors every so often telling them when the next update should be and then call them on that day.
    e.g waiting for a reply until end of the month, then call at end of the month.

    Detail when logging claims isn't always the same as it gets confusing.
    Sometimes passengers inside a car will say something totally diffrent to each other.
  • I dont actually have a solicitor i'm not claiming injuries my insurance company are dealing with it all. Do i need to get a solicitor?

    It is ok that your insurance are dealing with it, but most insurance companies are idiots.

    Even though your car was hit by someone else and there is nobidy to help him back up his side as he has left the county they should bail out and say we loose. But what will happen is they will drag it along for years.

    You need to get your insurance claim handlers to give you a update on what the person who hit you are saying, get a update every so often and call them when they say they will be calling you next as they have a pile and will call you when they get to it.

    If they say they will pay for all your bill then that means that they will pay the bill of the other side.

    Pedestrians don't have lights on them, do you run them down because you cannot see them?

    good point but thats why pedestrians with dark clothes are run over and we are advised to wear bright clothes at night

    I think most people would if they decided to run around a roundabout at night. Why hasn't your insurance company got onto the Eastern European's insurance company OP?
