Can i do anything about this rejected insurance claim?

hi, recently i was mugged and had a samsung galaxy s stolen from me. As a result of the mugging i was in hospital for the following day and was on bedrest by the hospitals advice until i got back to newcaste (the mugging took place in leeds where i am studying). It was not until i got back to newcastle that i reported my phone as stolen to the insurance company (3/4 days later) due to me not having access to a phone and not being able to block my phone online.

After putting the claim in i got a response saying the claim was rejected, i have since appealed twice but to no avail, due to the company saying that i breached thier terms by waiting over the 48 hours to block my phone.

Is there anything which i can do about this in order to get my phone back as i am still paying the cash for my contract and cant really afford it, as well as saving for a new phone.

    Have a look at the Financial Ombudsman Service's advice on making a complaint.

    Not having access to a phone for 3 or 4 days,
    There are hundreds of payphones in Leeds.
    If you reported it to the police they would have allowed you to ring from the station.
    You must have friends with free minutes.

    Cant see you having much luck with your insurance company to be honest.

    My flat mates had went home for the weekend and i had not even thought of payphones. When i reported it to the police i did so over the internet, after which they tried to come to my house, however could not find it (something to do with the house address not being registered on thier system).

    However i appreciate your response, but really hope your wrong (:

    To be honest Im a bit vicious when it comes to things like this.
    This scum have no idea how this sort of thing affects people both physically and mentally. Phones can be replaced but I'd cut their bloody hands off.
    Hope you recover well and get your insurance sorted.

    Just as an aside, i live in North Yorkshire now but a proper Geordie born and bred in Walker. eeh an a luv Newcastle me....:D

    Please let us know how you get on with your insurnace company, Keep any records ie with the police
    and go down the ombudsman route

    Conner, what on earth were you thinking about, mugged and you never gave your Insurance Companies loopholes a second thought, how on earth could you not know of their T&C.

    You may think you have good reasons to delay your claim, ie Hospitalisation, medical advice and of course the trauma of having been mugged etc etc, the IC would no doubt have you phoning them up from the hospital bed to meet their T&C


    Anyway back to your question, can you do anything, well yes you can.
    Write a letter to the IC highlighting, mugging-trauma-stress-hospital advice-bed rest etc, express your displeasure of their unfair decision, request for a final response to your claim (you need this before "officially complaining" to the FOS).

    It’s a bit long winded im afraid, it a shame the IC don’t see fit to understand you plight, but that’s IC's for you :o

  • Hi here are a few things I notice within your claim.

    You are elligible for a replacement phone as that is what insurance is for, and if you werent phoning maybe you were relaxing from the shock, its understandable.

    Did the police report include that your phone was stolen?
    Is there phone calls on the phone, e.g a £300 bill?

    If I was you I would phone the insurance company.
    Let them know that you have lost your phone and they are liable to pay for a replacement as that what insurance is for, [as for my call records if any calls are made after the 48 hour period you (policy holder not insurance) will be responsible]only add if you know there are no charges or charges you can pay.

    let them know that you will take this further to the ombudsman and you want a reply in writing from them of thier answer.
