Distance Selling experiences??

Hi all, thanks for checking this question out.
I ordered some items from a website and paid a premium delivery fee to have it delivered on a nominated day, namely today as I would be home and am going away next week.

DHL is the courier, I was checking the tracking status all morning only to see at 1pm it had been tracked to "Consignee Premises Closed" which I felt was a bit of an odd detail given I live in a block of flats. I checked to see if they just hadn't bothered to ring the bell but no card either.....not sure where they have tried to deliver to....??

Unfortunately, I saw this at 3pm, both the website I ordered from and the DHL helpdesk close by 2pm on a Saturday. The website does have a phone number and states it is checked by a call centre out of hours but I left a message and have heard nothing.

As I am now going to be away, I cannot accept the delivery of the goods any day other than tomorrow and I think its unlikely they will have gotten back to me by then. I cant re-arrange delivery for tomorrow either as I don't have the courier card.

I would like to cancel my order and under the distance selling regulations I can if I have not yet received the goods. I cannot find any cancellation policy on their website but don't see that it matters as long as I email the customer services department....

Would this be in keeping with what other people have done/ experienced/ attempted?? Any other advice??

I did a forum search but could only find queries relating to problems where they had actually received the items.

    Under DSR, you can reject the goods at any point from ordering up until 7 working days after delivery.

    So you can file for a refund immediately. They then have 30 days to refund you.

    Should the goods arrive between now and then, you should either reject them at the door, or send them back as soon as you get them.

    Whether you are liable for the return postage depends on what it states in the website's T&C. However if you reject the goods at the door then they are liable as the goods still belong to them until you have received them
    One important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.
