Driveway

I have a council house/flat (block of four) I have a piece of garden at the side of the house which I have been using as a drive (its all grass). I have a low fence with gates and a drop kerb for access. I spoke to the council about the fencing (different matter) and they have informed me that I need planning permission to use the garden as a drive.
The previous tenants used the area as a drive and the drop kerb has been there 20 years -
so does anyone know why I need permission as I thought if there was a dropped kerb then there would not be a problem with using the land as a drive.
